CRM-M-69795-2025 AND OTHER CONNECTED CASES - 2 -
2. While hearing all three petitions on 11.12.2025, 22.12.2025 and 27.01.2026, respectively, following orders were passed by this Court:-
“CRM-M-69795-2025
1. Prayer in this petition, filed under Section 482 of the BNSS, 2023 (earlier Section 438 Cr.P.C.), is for grant of anticipatory bail to the petitioners, who have been booked in a criminal case arising out of First Information Report, as detailed hereunder:- Name & age of Petitioner (s) FIR No. Date Section(s) Police Station District (1) Manjeet, aged about 36 years, and (2) Naveen, aged about 15 years (minor) 0409 19.11.2025 25 of Arms Act, Sections 109(1), 115, 126, 127(2), 190, 191(2), 191(3), 304, 351(3) of BNS, 2023 Barauda Sonipat
2.
Learned counsel for the petitioners, inter alia, contends that as per allegations levelled by the complainant namely Maman Singh, he was called by petitioner No.1 – Manjeet to her house to collect money allegedly borrowed by her, on earlier occasion. Complainant, armed with his licensed pistol, arrived in a car, bearing registration No.HR-11M-2538 at the house of the petitioners. It is alleged that an acquaintance of petitioner No.1 stopped the complainant’s car, went inside the house to fetch the money, while complainant remained seated in his vehicle. Suddenly, all the accused persons, namely (1) Naseeb, (2) Shubham, (3) Shaukeen, (4) Naveen, (5) Ramesh, and (6) Manjeet (wife of Ramesh), came running out of the house armed with sticks and rods, dragged the complainant out of his car, and gave him beatings. During the incident, accused Naseeb allegedly snatched the complainant’s licensed pistol from his pocket, dragged him to their house, and further assaulted him. It is also alleged that on being instigated by accused Ramesh and his wife Manjeet, Naseeb fired a shot at the complainant, but the bullet struck the wall and a glass pane.
3.
Learned counsel for the petitioner submits that this is effectively a case of no injury, and had there been any real intention to commit murder, accused persons would have fired at the complainant again. It is further argued that investigation does not reveal whether any money was ever borrowed by petitioner No.1 – Manjeet from the complainant, or whether any such call for repayment was actually made. Since, no specific injury has been attributed to any of the accused, including the petitioners, they are willing to join the investigation and cooperate fully, provided they are granted protection from arrest. Thus, counsel prays for grant of anticipatory bail to the petitioners in the present case.
4. Notice of motion.
5. On advance notice, Mr. Kanwar Sanjiv Kumar, AAG, Haryana, puts in appearance on behalf of the respondent – State, and seeks some time to file status report in the matter.
6. Adjourned to 23.02.2026.
7. Meanwhile, petitioners are directed to join the investigation as and when required to do so by the Investigating Agency. In the event of their arrest, the petitioners shall be released on ad-interim bail, subject to their furnishing bail bonds to the satisfaction of the Arresting Officer. The petitioners shall also abide by all the JAWALA RAM 2026.02.23 19:12 I attest to the accuracy and authenticity of this document

Learned counsel for the petitioner, inter alia, contends that as per allegations levelled by the complainant, namely, Maman Singh, he was called by co-accused – Manjeet, to her house to collect money allegedly borrowed by her, on earlier occasion. Complainant, armed with his licensed pistol, arrived in a car, bearing registration No.HR-11M-2538 at the house of the petitioners. It is further argued that the investigation does not reveal whether any money was ever borrowed by accused – Manjeet from the complainant, nor does it establish that any such call for repayment was actually made. Besides, it is also noticeable that petitioner – Shubham is aged about 16 years and no specific role has been attributed to him, as the pistol involved in the crime was fired by the co-accused – Naseeb. Since no specific injury has been attributed to any of the accused, including the petitioner, he is willing to join the investigation and cooperate fully, provided he is granted protection from arrest. Thus, learned counsel prays for grant of concession of anticipatory bail to the petitioner in the present case. 4. Notice of motion. 5.
