The Court made the following Order:
Heard the learned counsel for the petitioner, the learned Assistant Government Pleader for the respondent Nos.1 to 4 and the learned counsel appearing for the 5th respondent. 2. This writ petition was filed questioning the action of the 2nd respondent in taking over the appeal filed by the 5th respondent under Section 5 (5) of the Andhra Pradesh Rights in Land and Pattadar Pass Books Act, 1971 and converting the same as revision petition suo-motu. 3. Both the learned counsels submit that the appeal No.874 of 2020 was filed before the Appellate Authority cum Revenue Divisional Officer at Anakapalli/the 3rd respondent herein by the 5th respondent herein under Section 5-B of the Andhra Pradesh Rights in Land and Pattadar Passbooks Act, 1971 against the orders passed by the 4th respondent herein in R.C.No.24 of 2020. For various reasons it could not be proceeded with and somehow on the representation made by the parties concerned, the 2nd respondent suo-motu taken up the said appeal on file to treat it as revision under Section 9 of the said Act. But no orders are pronounced yet. Now that this writ petition is to seek appropriate relief for pursuing the appeal before the 3rd respondent. 4.
In view of the above said facts and circumstances, as the appeal was already filed and numbered before the 3rd respondent under Section 5-B of the

said Act and the same is pending, the 3rd respondent is directed to proceed with the said appeal strictly in accordance with law, giving due opportunity for all the parties concerned, including the petitioner and the 5th respondent herein and appropriate orders shall be passed as expeditiously as possible preferably within a period of three (03) months from the date of receipt of the appeal from the 2nd respondent. The 2nd respondent shall sent back the file by transmitting the same to the 3rd respondent at the earliest within a period of four (04) weeks from the date of receipt of this order. 5. Accordingly, this Writ Petition is disposed of. Interim order, if any, deemed to have been vacated. There shall be no order as to costs.
