Photocopy thereof was made available for perusal. The compliance affidavit inter alia reads as under:-
“Thus, the petitioner HHC Raj Kumar secured 38.16 marks out of 100 in Outdoor, Interview and other qualifications, added to his Indoor (written) marks of 88.75, his final combined score stands at 126.91 marks. On analysis of the B-I merit list, his placement corresponds to Sr. No.173 {i.e. below C. Vikram Singh No.493 (127.05 marks) and above C.Tilak Raj No.854 (126.50 marks)}. Consequently, his seniority is to be fixed alongwith the candidates of the 19th Batch of the Lower School 1 Whether reporters of print and electronic media may be allowed to see the order? Yes.
2 Course, term ending May 2013 as his counter parts. It is pertinent to mention here that as per Rule 13.8(2) (a) of the PPR as applicable in the State of H.P amended and notified by the government vide notification dated 12.08.2012 provides that:-
“(a) minimum 60% posts shall be filled up on merit through B-I Test subject to passing of Lower School Course;” Therefore, the petitioner Raj Kumar ( Honorary HC) can be promoted to the rank of Head Constable and his merit shll be considered alongwith his counterparts of the 19th Batch of the Lower School Course (term ending May 2013) as per overall marks obtained in B-1 test (Indoor+outdoor+ others) i.e. 126.91 marks. He may be recommended to undergo the Lower School Course in the next upcoming batch, and his promotion shall be subject to the condition of successfully passing the said course.”
