The present petition has been filed by the petitioner with a prayer for consideration of his candidature for the post of Physical Training Instructor/Physical Education Teacher pursuant to Advertisement No. 8/2022 dated 16.06.2022. 2. Learned counsel for the petitioner submits that the candidature of the petitioner has been wrongly rejected by the respondents. He further submits that there was no fault on the part of the petitioner in respect of the marksheet issued by the concerned University. He further submits that the writ petition may be allowed and the candidature of the petitioner be considered for appointment to the post of Physical Education Teacher. It is an admitted position that as per the terms of Advertisement No. 8/2022 dated 16.06.2022, Clause-7 (reproduced below), the petitioner was mandatorily required to acquire/produce the prescribed educational qualification prior to the date of examination: 7. पात्रता एवं शैक्षणिक योग्यता :– (I) किसी मान्यता प्राप्त बोर्ड से सीकियर सें र्डरी या उसे समतुल्य परीक्षा साथ ही सरार/ राष्ट्र ीय अध्याप किक्षा परिरषद द्वारा मान्यता प्राप्त ारीरिर किक्षा में प्रमाण पत्र (सी. पी. एर्ड.) या ारीरिर किक्षा में किर्डप्लोमा (र्डी. पी.एर्ड.) या ारीरिर किक्षा में स्नात (बी.पी.एर्ड.) (II) देवागरी कि,किप में कि,खी किहंदी में ाय रे ा ज्ञा एवं राजस्था ी संस्कृ कित ा ज्ञा। जो व्यक्ति6 पाठ्यक्रम े अंकितम वष ी परीक्षा में उपक्तिस्थत हुआ है या सक्ति<कि,त हो रहा ही, जो इ कियमों में उल्लेक्तिखत पद े कि,ए ैक्षकिण योग्यता ी आवश्यता है या सीधी भतC े कि,ए उ6 पद े कि,ए आवेद रे े कि,ए पात्र होगा ,ेकि वह/ उसे उपयु6 चय एजेंसी ो अपेकिक्षत ैकिक्ष योग्यता – प्राप्त रे ा प्रमाण प्रस्तुत रा होगा 1. मुख्य परीक्षा में उपक्तिस्थत होे से पह,े, जहां कि,क्तिखत परीक्षा और साक्षात्कार े दो चरणों े माध्यम से चय किया जाता है। 2. साक्षात्कार में उपक्तिस्थत होे से पह,े जहां कि,क्तिखत परीक्षा और साक्षात्कार े माध्यम से चय किया जाता है। 3. कि,क्तिखत परीक्षा या साक्षात्कार में उपक्तिस्थत होे से पह,े जहां े व, कि,क्तिखत परीक्षा या े व, साक्षात्कार े माध्यम से चय किया जाा है जैसा भी माम,ा हो। नोट : – इस भतC हेतू किधारिरत ैक्षकिण योग्यता े अंकितम वष में सक्ति<कि,त होे वा,े है या सक्ति<कि,त हो रहे है अभ्यथC आवेद र सें गे परंतु किधारिरत ैक्षकिण योग्यता इस भतC ी परीक्षा कितकिथ से पूव अकिजत री अकिवाय होंगी। अन्यथा परीक्षा े बाद ैक्षकिण योग्यता अकिजत रे वा,े अभ्यकिथयों ो इस भतC हेतू पात्र हीं माा जाएगा। 5. From a perusal of the record, it is quite surprising that, as per Annexure-8, the petitioner cleared the IIIrd Semester Examination, which was held in December 2022, and the [2025:RJ-JP:37985] (3 of 3) [CW-19512/2023] marksheet was issued on 28.01.2023, whereas the IVth Semester Examination was held in June 2022, and its marksheet was issued on 17.01.2023, which is totally incomprehensible. 6. It is also pertinent to mention here that the relevant competitive examination for the said post was conducted on 25.09.2022 and a perusal of the petitioner's marksheet for IVth Semester (Annexure-9) reveals that the same was issued on 17.01.2023, i.e., much after the date of the competitive examination. 7. In view of the above, the petitioner failed to acquire the required qualification before the cut off date i.e. 25.09.2022, therefore, it cannot be said that the rejection of the petitioner's candidature was arbitrary or perverse in any manner. 8. However, it is observed that the petitioner shall be at liberty to take appropriate remedies against the concerned University for the irregularities committed in issuance of the petitioner's marksheet, if so advised. 9. Accordingly, the present writ petition, being devoid of merit, stands dismissed. 10. The stay application and all pending applications, if any, also stand disposed of. (MANEESH SHARMA),J Seema/144
