2. The petitioner by filing this writ petition has prayed for
consideration of his case for promotion to the post of Joint Secretary from the post of Deputy Secretary w.e.f 01.04.2025.
3. It is the case of the petitioner that the petitioner’s name figures at serial no. 685 of the combined seniority list and the person whose name figured at serial no. 684 had already been promoted.
4. The grievance of the petitioner is that he is superannuating on 31.10.2025 and there are posts vacant and the petitioner can be promoted but for the reasons best known, the respondents are not promoting the petitioner though the immediate senior to the petitioner, as per the seniority list, has been promoted.

Learned counsel appearing on behalf of the State submits that if the petitioner files fresh representation before the respondent no. 3-Secretary, Department of Personnel, Administrative Reforms and Rajbhasha, his case can be considered and if found that the petitioner is entitled to and if there are posts vacant, his case can be considered, as per the law.
6. Considering the submission made by the parties, I direct the petitioner to file fresh representation before the respondent no.3-Secretary, Department of Personnel, Administrative Reforms and Rajbhasha within four weeks, who will consider the case of the petitioner.
7. On receipt of the said representation, the Secretary, Department of Personnel, Administrative Reforms and Rajbhasha will decide the claim of the petitioner within eight weeks thereafter. If the case of the petitioner needs to be placed before any Committee the same should also be placed before the Committee.
8. After considering the said representation, reasoned order should be passed by the Secretary, Department of Personnel, Administrative Reforms and Rajbhasha.
9. If the petitioner is entitled for any promotion and consequential benefits, the same should be extended to the petitioner. If the respondents rejects the claim of the petitioner, for any reasons whatsoever, the same should be communicated to the petitioner within a period of four weeks thereafter.
10. With the aforesaid observation and direction, this writ petition is disposed of.
