This is a bail application U/S.483 of BNSS by the petitioner for grant of bail in connection with Bareipali PS Case No.172 of 2023 corresponding to ST Case No.61/05 of 2024 pending in the file of learned Addl. Sessions Judge-cum-PO, Designated Court under OPID Act, Sambalpur for commission of offences punishable U/Ss.302/34 of IPC, on the main allegation of committing murder of one Bholu @ Abdul Sajid by assaulting him, along with co-accused persons. 3. Heard, Mr. Manas Kumar Chand, learned counsel for the Petitioner and Mr. R.B. Mishra, learned Addl. PP in the matter and perused the record including the copy of deposition of PW1 to PW7. 4. After having considered the rival submissions and taking into account the nature and gravity of the offence as alleged against the petitioner vis-a-vis the accusations sought to be brought against him and regard p. 2 being had to the pre trial detention of the Petitioner in custody since 21.12.2024, but witnesses to the disclosure statement of the Petitioner having not yet been examined and the Petitioner having 14 criminal antecedents together with the circumstance in which the crime was allegedly executed, this Court does not consider it proper to grant bail to the Petitioner at this stage. 5. Hence, the bail application of the petitioner stands rejected. It is open to the Petitioner to renew his prayer for bail after examination of witnesses namely Jayaprakash Mohanty and Pravati Singh Jagdella. 6. Accordingly, the BLAPL stands disposed of.
