Petitioner has been made accused in connection with Dandai P.S. Case No. 35 of 2025 corresponding to POCSO Case No. 66 of 2025 for the offences registered under Sections 137(2), 87, 96, 61(1), 142 of the B.N.S., 2023 and cognizance has been taken for the offences under Sections 137(2), 64(2)(m), 87, 96, 142 of the B.N.S., 20223 and Sections 4 / 6 of the POCSO Act, pending in the Court of learned Special Judge, POCSO Act, Garhwa.

On 16.04.2025 at about 4.00 pm, the petitioner and co-accused persons abducted the daughter of the informant.

The statement of the victim has been recorded under Section 183 B.N.S.S., in which, she has stated that the petitioner had raped her.

Mr. Rohit, learned counsel appearing for the petitioner has submitted that co-accused Ranjit Kumar Gupta has been granted bail by this Court earlier.

Mr. Nawin Kumar Singh, learned A.P.P. appearing for the State has opposed the prayer for bail and submitted that there is no allegation of rape against co-accused Ranjit Kumar Gupta.

Considering the nature of allegation, I am not inclined to enlarge the petitioner on bail. Accordingly, his prayer for bail is rejected.
