The case of the petitioner is that the petitioner is entitled for promotion under the 10 Year Time Bound Scheme, the Merit Promotion Scheme as well as the Career Advancement Scheme, to the post of Associate Professor. 2025:JHHC:31715 2 3. Learned counsel representing the petitioner submits that though the petitioner is entitled for the aforesaid promotion, the respondents have not yet decided the claim of the petitioner. 4. Learned counsel representing the respondent – Nilamber Pitambar University, submits that if the petitioner files a fresh representation annexing copy of the documents in support of his claim, the same will be considered and an appropriate decision will be taken including recommending the matter to the JPSC. 5. Learned counsel representing the respondent – JPSC, submits that once the recommendation is received by them from the University, they can proceed in the matter. 6. Considering the submission of the petitioner, I direct the petitioner to file a detailed representation before the Registrar, Nilamber Pitamber University, within four weeks. 7. The Registrar, Nilamber Pitamber University, will consider the case of the petitioner and if it is found that the case of the petitioner can be recommended under any Scheme for promoting the petitioner to the higher post, they will forward the recommendation to the JPSC. 7.1. If the respondent – University finds that the petitioner is not entitled for any such recommendation, the reasons thereof should be communicated to the petitioner. 7.2. In alternative, if a recommendation in favour of the petitioner is sent to the JPSC, the JPSC will process the same and after completion of the procedures, will pass an appropriate order and communicate the same to the respondent - University, who will 2025:JHHC:31715 3 act according to the said recommendation. If the respondent - JPSC rejects or does not concur with the recommendation, the reasons thereof should be communicated to the petitioner. 7.3. The respondent - University will complete their part of work within four weeks from the date of receipt of representation. The respondent – JPSC on receipt of such recommendation will complete their procedures within a period of ten weeks from the date of receipt of recommendation. 8.
