The petitioner has placed reliance on the judgment rendered by the Co-ordinate Bench in W.P.No.22270/2023 dated 06.10.2023 in an identical set of facts. 3. Learned HCGP, on instructions, submits that the petitioner’s application will be considered by the Committee and appropriate orders will be passed. He has also brought to the notice of this Court that the Committee is already constituted - 3 - NC: 2025:KHC:708 WP No. 26052 of 2024 and application will be decided in accordance with law provided some reasonable time is given. 4. Recording the submission of the learned HCGP, this Court proceeds to pass the following; ORDER (i) The writ petition is allowed. (ii) The Committee comprising of respondent No.3 - Tahasildar is hereby directed to decide the application filed in Form No.53 strictly adhering to the requisite conditions of unauthorized occupation.
