Heard learned counsels for petitioner and for State.

This application has been filed for regular bail to the petitioner in connection with Nagar Untari P.S. Case no.242 of 2024 for the offence under sections 80(2)(3)(5) of the BNS, 2023, pending in court of learned Additional Chief Judicial Magistrate, Nagar Untari, Garhwa.

Learned counsel for petitioner submits that the petitioner happened to be husband of the deceased and there is no eye witness to the incidence. He further submits that the deceased has committed suicide. He then submits that when the petitioner was returning back to work place to Surat and his deceased wife has also insisted to go along with the petitioner and the petitioner has advised her not to go to Surat as it is not advisable to take ten months old baby there due to cold. He then submits that the charge sheet has already been submitted and the

petitioner is in custody since 17.02.2025 and on these grounds, he submits that regular bail may kindly be granted to the petitioner.
5. Learned State counsel opposes prayer and submits that the petitioner is husband of the deceased and in view of that, bail may not be granted to the petitioner.

Considering that the petitioner has asked the wife not to accompany to Surat and thereafter she has consumed poison which caused to be a reason for her death and there is no eye witness to the occurrence and the petitioner is in custody since. 17.02.2025, I am inclined to grant regular bail to the petitioner.

Accordingly, petitioner, above named, is hereby directed to be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of like amount each, to satisfaction of learned Additional Chief Judicial Magistrate, Nagar Untari, Garhwa, in connection with Nagar Untari P.S. Case no.242 of 2024.
