CMP No.29796 of 2025 By way of this application, a prayer has been made by the applicant for deletion of its name from the array of respondents. Learned Senior Counsel for the applicant submits that the applicant was not originally impleaded as a respondent, but it filed an application for its impleadment, which was allowed. Learned Senior Counsel further submits that during the pendency of these proceedings, certain developments have taken place which stand mentioned in the application and now, as the applicant is not a necessary party for the adjudication of this petition as it is not going to be affected by the outcome of the petition, its name may be deleted from the array of respondents. Though, the prayer is objected to by learned Counsel for the non-applicant/petitioner, but this Court is of the considered view that as the applicant was not initially impleaded as a party and it got impleaded on an application filed by it, its prayer for deletion obviously cannot be opposed to by the non-applicant/petitioner, because the effect of allowing the application would be that the memo of parties shall be as it was when the petition was filed. Accordingly, in light of above observations, this application is allowed and the name of respondent No.5 is ordered to be deleted as a party respondent. The application stands disposed of.
