At Present Tenant Bm Plaza, Manas Aspatal Ke Pass, Dhawas Police Station Karni Vihar District Jaipur. At Present In Central Jail, Jaipur. ----Petitioner Versus State Of Rajasthan, Through PP ----Respondent For Petitioner(s) : Mr. Santosh Guria For Respondent(s) : Mr. S.R. Dhakar, PP HON'BLE MR. JUSTICE PRAVEER BHATNAGAR Order 24/02/2025 1. The instant bail application has been filed under Section 483 BNSS on behalf of accused-petitioner. The petitioner has been arrested in connection with FIR No.1171/2024 registered at Police Station Muhana, District Jaipur City (South) for the offence(s) under Section 3/25 of Arms Act. 2. Learned counsel for the accused-petitioner submits that the accused-petitioner has falsely been implicated in this case. He further submits that in a subsequent FIR registered against the accused-petitioner, the accused-petitioner has been enlarged on bail by the Co-ordinate Bench vide order dated 18.02.2025. It is contended that the accused-petitioner is in custody since long and trial of the case may take considerable time, therefore, [2025:RJ-JP:8116] (2 of 2) [CRLMB-14679/2024] considering the long incarceration of the accused-petitioner, the bail application of the accused-petitioner may be allowed. 3. Learned Public Prosecutor has vehemently opposed the bail application and contended that the accused-petitioner is a habitual offender and apart from this FIR, another FIR is also registered for the offences under Sections 308(4) and 61(2)(b) of BNS against the accused-petitioner, therefore, the bail application of the accused-petitioner may be dismissed. 4. Heard and perused the material available on record. 5. It is not desirable to express anything on the merits of the case. Considering the fact that the accused-petitioner is in custody since long and criminal antecedents shown against the accused- petitioner is subsequent to this FIR and in the said FIR, the accused-petitioner has already been enlarged on bail, therefore, I deem it just and proper to enlarge the accused-petitioner on bail. 6. Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioner Mohit Chhapola S/o Jagdish, in connection with FIR No.1171/2024 registered at Police Station Muhana, District Jaipur City (South), shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing and as and when called upon to do so.
