Tanwar with Mr. Rohit Tiwari for Mr. Shobit Tiwari HON'BLE MR. JUSTICE MAHENDAR KUMAR GOYAL
Judgment / Order 07/08/2025 This writ petition under Article 227 of the Constitution of India is directed against the order dated 15.09.2023 passed by the Rajasthan Civil Services Appellate Tribunal, Jaipur (for short, ’Tribunal’) whereby, while allowing the appeal No.55/2020 preferred by the respondent, a direction was issued to adjust him to the post of Assistant Sub-Inspector against the vacancies for the year 2015-2016 with all consequential benefits. On 28.04.2025, learned counsel for the petitioners had argued, assailing the validity of the order impugned dated 15.09.2023, that the Tribunal erred in directing the adjustment of the respondent to the post of Assistant Sub-Inspector against the vacancies for the year 2015-16 under the special promotion quota
[2025:RJ-JP:30408] (2 of 2) [CW-18851/2024] inasmuch as he was required to pass the qualifying examination as well as promotion cadre course for promotion to the aforesaid post in which he failed. Since, the writ petition was bereft of any such averment, on his request, learned counsel for the petitioners was granted two weeks’ time to subtantiate his submission by way of an additional affidavit. The affidavit pursuant thereto was filed by Smt. Shilpa Chaudhary-Additional DCP (HQ), Police Commissionerate, Jaipur wherein, it was categorically admitted that no qualifying examination is conducted for providing special promotion; however, it is essential to pass the promotional syllabus. It is not disputed before this Court that the respondent has already passed the promotional syllabus pursuant to his promotion as Assistant Sub-Inspector. On 28.05.2025, learned counsel for the petitioners could not dispute that erroneous submission came to be made on 28.04.2025 assailing the validity of the order passed by the Tribunal whereupon, he prayed for and was granted four weeks to ensure compliance of the order dated
15.09.2023. Admittedly, thereafter, compliance has been made.
Learned counsel for the petitioners is not able to offer any argument to assail the validity of the order impugned dated 15.09.2023 passed by the Tribunal which already stands complied by them. In view thereof, nothing survives for consideration of this Court in the writ petition which is dismissed accordingly.
