( 2025:JHHC:30928 ) 1 Cr.M.P. No.199 of 2023 IN THE HIGH COURT OF JHARKHAND AT RANCHI Cr.M.P. No. 199 of 2023 Amit Kamal, son of Late Surendra Singh, aged about 41 years, Permanently Residing At –Quarter No. J-43, P.O. & P.S. –Sindri, District –Dhanbad, Jharkhand. PIN -828122. Presently Residing At –House No. 179, Gopal Kunj, 1st Floor, P.O.+P.S. –Patpar Ganj Village, Pandav Nagar, District –East Delhi, Delhi. PIN - 110092. .... Petitioner Versus 1. The State of Jharkhand 2. Jyoti Singh, wife of Mr. Amit Kamal, daughter of Sh. Kailash Singh, aged about 30 years, Resident of Village –Singhara, P.O. & P.S. – Singhara, Singhra Bhawan, Jail Hatha Road No.-2, District – Palamau, Jharkhand. PIN -822101. …. Opp. Parties P R E S E N T HON’BLE MR. JUSTICE ANIL KUMAR CHOUDHARY ….. For the Petitioners : Mr. Anjani Nandan, Advocate For the State : Mr. Pankaj Kumar, P.P. ….. By the Court:- 1. Heard the parties. 2. This criminal miscellaneous petition has been filed invoking the jurisdiction of this Court under Section 482 of the Cr.P.C. with the prayer to quash the orders dated 02.09.2020, 21.09.2020, 08.12.2021, 11.02.2022, 07.05.2022, 15.07.2022, 13.08.2020 and 24.08.2022, passed by the learned Judicial Magistrate -1st Class, Palamau in connection with Complaint Case No. 2685 of 2017 by which the learned Judicial Magistrate -1st Class, Palamau has in wrongful manner cancelled the bail bond of the petitioner and ( 2025:JHHC:30928 ) 2 Cr.M.P. No.199 of 2023 simultaneously issued non-bailable warrant of arrest against the petitioner. 3. Perusal of the record reveals that false statement has been made by the petitioner in page -10 of this criminal miscellaneous petition that on 21.09.2020, the counsel of the petitioner deposited a demand draft of Rs.5,00,000/- and the same was kept in the record. So there was no rhyme or reason to quash the said order. Similarly, on 08.12.2021, in the said Complaint Case No. 2685 of 2017, the learned Judicial Magistrate -1st Class, Palamau at Daltonganj allowed the representation petition of all the accused persons of the case obviously including the petitioner and fixed the case to 11.02.2022 for evidence before charge. So there is no rhyme or reason to quash the said order. On 11.02.2022, though the petitioner was absent, still the learned Judicial Magistrate -1st Class, Palamau at Daltonganj fixed the case on 07.05.2022 for evidence before charge. So there is also no plausible reason to quash the said order. On 07.05.2022, the case could not be taken up, hence the case record was placed before the learned Judicial Magistrate -1st Class, Palamau at Daltonganj on 15.07.2022 and on 15.07.2022, the co-accused persons were present in the court and the case was fixed to 24.08.2022 and on 24.08.2022 the accused persons were represented through their advocate which was allowed but they were directed to remain physically present on 14.12.2022. ( 2025:JHHC:30928 ) 3 Cr.M.P. No.199 of 2023 4. So there is no justifiable reason to interfere with any of the orders sought to be quashed by the petitioner and this petition is a frivolous one made with false averments, only to waste the time of the Court. 5. Accordingly, this criminal miscellaneous petition is dismissed with a warning to the petitioner to desist from filing such frivolous petition in future. (Anil Kumar Choudhary, J.)
