In compliance of the order of this Court dated 3.4.2025/14.5.2025 instruction dated 26.05.2025 sent by Consolidation Officer, Hasanpur, Amroha, placed before this Court, is taken on record. 2.Heard learned counsel for the petitioner and Mr. Tarun Gaur, learned Standing Counsel for the State-respondents. 3.The instant writ petition has been filed for the following relief: "(i) Issue a writ, order or direction in the nature of mandamus directing and commanding the respondents authority to measured the Gata No.458/5 in Chak No.52 and possession should be given to the petitioner as early as possible. 2. Issue a writ, order or direction in the nature of Mandamus directing the respondent No.2 to decide the presentation/application dated 04.11.2024 (Annexure No.2) given by the petitioner before the respondent No.2." 4. Mr. Tarun Gaur, learned Standing Counsel for the State- respondents on the basis of the instruction submitted that authorities have demarked plot in question and possession of the chak has been delivered to the petitioner/Narendra Kumar. He further submitted that spot memo prepared by the authorities is annexed along with instruction. He submitted that petitioner/Narendra Kumar was satisfied with the proceeding and signed the memo prepared by the authorities. 5. Perusal of the instruction dated 26.05.2025 sent by the authority will be relevant which is as under:- " उक ररट ययचचकय मम मयनननय उचच नययययलय दयरय पयररत आददश चदनयनक 03.04. 2025 दयरय मयमलद कद समबनध मम अननददश (Instructions) पसतनत चकयद जयनद कद चनदरश चदयद गयद हह। मयनननय उचच नययययलय दयरय पयररत आददश चदनयक-03.04.2025 कद समयदर मम अननददश चनमनवतत हह। 1- गयम जहततलन ए० तहसनल कद जजत चकबनदन आकयर पत-23 भयग-1 कद चक स०-52 मम पसतयचवत गयटय सन०-468/5 चम० कदतफल 0.876 हद0 पर ययचन शन नरमद कन मयर पनत शन गनगयरयम ससनह कय नयम अनचकत हह। 2- ययचन दयरय चदनयनक-04.11.2024 कज जनपद अमरजहय कक तहसनल हसनपनर मम आयजसजत समपपरर समयधयन चदवस मम गयटय सन0-468/5 कक पहमयइश कर व कबजय चदलययद जयनद हदतन पयररनय पत चदयय गयय रय। ततसमय उक गयटय सन0-468/5 मम मतकद पर गनद कक फसल खडन हजनद कद कयरर सरलनय पहमयइश कय कययर समभव नहह रय। अतत उक पयररनय पत पर कदतनय चकबनदन असधकयरन हसनपनर दयरय यह आखयय चदनयनचकत 13.11.2024 दन गयन चक उक गयटय सन0-468/5 मम सरल पर गनद कक फसल खडन हह। फसल कटनद कद उपरयनत उक गयटद/ चक कक पहमयइश कर दन जययदगन। 3- कदतनय सहययक चकबनदन असधकयरन हसनपनर दयरय चदनयनक 20.05.2025 कज ययचन कद चक सन० 52 सजससद गयटय सन0 468/5 कदतफल 0876 हद0 पसतयचवत हह , कक सरल पर ययचन कक उपससरचत मम पहमयइश करकद उसद समपपरर चक पर कबजय चदलय चदयय गयय हह। सजससद ययचन सनतनष हह। सहमचत सवरप ययचन कद हसतयकर आखयय पर अनचकत हह। सरलनय पहमयइश आखयय चदनयनचकत 26.05.2025 कक मपलपचत इस अननददश कद सयर सनलग हह। (सनलगक-1) सहययक चकबनदन असधकयरन चकबनदन असधकयरन हसनपनर हसनपनर 6. Considering the facts mentioned in the instruction dated 26.05.2025, no further cause of action survives in the matter. 7. The writ petition is disposed of accordingly.
