Order No.
ORDER(ORAL)23.04.2026
01. 1. This is a bail application U/S.483 of BNSS by the petitioner for grant of bail in connection with Dhusuri PS Case No.489 of 2025 corresponding to GR Case No.867 of 2025 pending in the file of learned JMFC, Dhamnagar for commission of offences punishable U/Ss.376(2) (n) (f) / 354-C of IPC, on the main allegation of committing repeated rape upon the victim by capturing her nude photographs and threatening her to viral it. 2. In the course of hearing Mr. Lalatendu Samantaray, learned Sr. counsel who is being assisted by Mr. Umakanta Barik, learned counsel for the petitioner submits that the occurrence took place in the year 2018, but the FIR was lodged in the year 2025 and therefore, the allegation levelled against the petitioner has no legs to stand, rather the victim has illegally framed the petitioner in this case and therefore, the petitioner may kindly be granted bail. 3.1 On the other hand, Mr. T.K. Acharya, learned Addl. PP by referring to the allegation on record submits that the petitioner has not only ravished the victim once, but he has done such illegal act repeatedly and therefore, p. 2 the bail application of the petitioner may kindly be rejected. 4. After having considered the rival submissions upon perusal of record, there appears allegation against the petitioner for ravishing the victim, but learned counsel for the petitioner submits that the offence has been committed in the year 2018 and the report has been made in the year 2025, however, the allegation on record reveals that the victim has allegedly been ravished by the petitioner on several occasions in the year 2018, 2019, 2022 by threatening to viral her photographs and thereby, the allegation raised against the petitioner appears to be a continuous offence. In such view of the matter and taking into consideration the nature and gravity of the offences as alleged against the petitioner vis-à-vis the accusation sought to be brought against him and regard being had to the materials placed on record and keeping in view the other circumstances on record in entirety, this Court is not inclined to grant bail to the petitioner at this stage, especially when the victim is yet to be examined. 5. Hence, the bail application of the petitioner stands rejected. Accordingly, the BLAPL stands disposed of. Issue urgent certified copy of the order as per Rules.
A soft copy of this order be immediately communicated to the concerned Court. (G. Satapathy)
