The petitioner has been made accused in connection with Dumri P.S. Case No. 26 of 2025 (POCSO Case No.71 of 2025), for the offences registered under Sections 87/352/351 of the B.N.S., 2023 and Sections 4 & 6 of the POCSO Act. Charge has been framed under Sections 87, 351(2), 352 of the B.N.S. and Sections 8 and 12 of the POCSO Act, pending in the court of learned Special Judge, POCSO Act, Giridih. Petitioner is alleged to have enticed away the daughter of the informant with intention to marry her. From the impugned order, it appears that statement of the victim was recorded under Section 183 of the B.N.S.S., in which she has stated that she has left her lawful guardianship according to her own wish. Age of the victim has been opined to be 17 years. This appears to be a case of adolescent love affair between the parties. In view of the aforesaid facts, I am inclined to enlarge the petitioner on bail. Accordingly, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each, to the satisfaction of learned Special Judge, POCSO Act, Giridih, in connection with Dumri P.S.
