THIS WRIT PETITION, COMING ON FOR ORDERS, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR JUSTICE SURAJ GOVINDARAJ ORAL ORDER 1. The Petitioner is before this Court seeking for the following reliefs: a. Issue a writ of mandamus directing the R1 to dispose off the proceedings No. KSC ST/82/14-15 at the earliest pending before it filed by 2nd to 12th Respondent vide Annexure-E - 4 - NC: 2025:KHC:17255 WP No. 26054 of 2024 b. Issue a writ, order or direction which may deem fit to be granted in the circumstances of the case, in the interest of justice and equity. 2. The grievance of the petitioner that the application filed by the Respondent under Section 5 of the Karnataka Scheduled Castes and Scheduled Tribes (Prohibition of Transfer of Certain Lands) Act, 1978 (for short, ‘PTCL Act’) has not been considered for last 11 years and it is in that background that the aforesaid relief is sought for. 3. No petition filed under Section 5 of PTCL Act could have been kept pending for last 11 years. 4. On enquiry with the learned AGA as to whether all the case details and the proceedings pending before the quasi-judicial authorities under the PTCL Act are webhosted and available for consumption of the general public as made available for other revenue court cases, he fairly submits that such a system has not been put in place for proceedings under the PTCL - 5 - NC: 2025:KHC:17255 WP No. 26054 of 2024 Act. In that view of the matter, I am of the considered opinion that a similar system as made available by the Revenue Department for Revenue Court Cases before the Deputy Commissioner, Assistant Commissioner, etc., should also be made applicable to all other quasi-judicial authorities coming under the Revenue Department handling proceedings under all the enactments including PTCL Act and the same to be made available in a similar manner as available in the Revenue Court Management System by incorporating proceedings under the PTCL Act into that system. The Principal Secretary, Revenue Department and the Principal Secretary, E-Governance Department are directed to looked into the same and submit a detailed project report within four weeks from the date of receipt of copy of this order. - 6 - NC: 2025:KHC:17255 WP No. 26054 of 2024 5. In that view of the matter, I pass the following: ORDER 1) The Writ Petition is allowed. 2) A mandamus is issued directing Respondent No.1 to dispose of the proceedings in No.KSC- ST/82/14-15 as expeditiously as possible. 3) Though the above petition is disposed, relist on 30.7.2025 for reporting compliance.
