SPP FOR R1) VISHAL NINGAPPA PATTIHAL Digitally signed by VISHAL NINGAPPA PATTIHAL Location: High Court of Karnataka, Dharwad Bench, Dharwad THIS WRIT PETITION IS FILED UNDER ARTICLES 226 AND 227 OF THE INDIAN CONSTITUTION R/W SEC 482 OF THE CODE OF CRIMINAL PROCEDURE 1973, PRAYING TO QUASH THE ENTIRE CHARGE SHEET AS AGAINST THE PETITIONER IN S.C NO. 5002/2023, VIDE ANNEXURE-C IN RESULTANT THE FIR AND COMPLAINT IN CRIME NO. 125/2019 OF PUTTUR TOWN P.S FOR THE OFFENCES PUNISHABLE AGAINST THE PETITIONER UNDER SEC 120(B) AND SEC 34 OF IPC 1860 ARRAIGNING THE PRESENT PETITIONER AS THE ACCUSED NO. 5 PENDING ON THE FILE OF V ADDL. DISTRICT AND SESSIONS JUDGE PUTTUR AT D.K (VIDE ANNEXURE-A AND B) AND ETC., THESE WRIT PETITIONS HAVING BEEN HEARD AND RESERVED ON 15.01.2025 AND COMING ON FOR PRONOUNCEMENT, THIS DAY, THE COURT MADE THE FOLLOWING: CAV ORDER The petitioner-accused No.5 is at the doors of this Court calling in question proceedings in S.C.No.5002 of 2023 registered for offences punishable under Section 120B r/w Section 34 of the IPC. 2. Heard Smt Yuktha N and Anush N, learned counsel appearing for petitioner and Sri Jagadeesh B N, learned Additional State Public Prosecutor appearing for respondent No.1. 3. Facts adumbrated are as follows: It is the case of the prosecution that on 26-11-2019 at 6.30 p.m., all the accused come together in a restaurant and hatch a conspiracy to finish off the complainant. The hatching of conspiracy leads to the execution of the act. Execution of the act leads to injuries to the complainant. The petitioner was not named as an accused at the time of commission of the offence. The police conduct investigation, records statements of the witnesses and then come to conclude, on the basis of certain statements made by the co-accused, that the petitioner is also involved in the crime. The police then file a charge sheet for the afore-quoted offences and insofar as the petitioner is concerned arraign him as accused No.5 and hold him to be a part of the conspiracy as obtaining under Section 120B of the IPC. Since the offence involved against others was punishable under Sections 447, 307 of the IPC and Sections 3 and 25 of the Indian Arms Act, the matter was committed to the Court of Sessions. As observed hereinabove, insofar as the petitioner is concerned, what has drawn him into the web of the proceedings is hatching of a conspiracy. On committal to the Court of Session and registration of S.C.No.5002 of 2023, the petitioner-accused No.5 is before this Court, calling in question the taking of cognizance against the petitioner and the order of committal. 4. The solitary submission of the learned counsel for the petitioner is that except the voluntary statement of accused No.1, there is no other material to corroborate the role of the petitioner in the commission of the crime. He would contend that the drawing up of the petitioner into the web of crime is hit by Section 25 of the Evidence Act, as there can be no trial against a person only on the voluntary statement of other accused. 5. Per-contra, the learned Additional State Public Prosecutor Sri B. N. Jagadeesh would vehemently refute the submission to contend that investigation led to clear role of the petitioner as being part of the conspiracy. It is not only the statement of accused No.1, but there is abundant material at the hands of the prosecution with regard to the role of the petitioner. He would therefore, submit that it is a matter of trial for the petitioner to come out clean, as Section 27 of the Evidence Act protects those cases where the accused are drawn into the web of proceedings on account of voluntary statements, but they are corroborated with other evidence. 6. I have given my anxious consideration to the submissions made by the learned counsel for the respective parties and have perused the material on record. 7. The afore-narrated facts are not in dispute. It is the case of the prosecution that on 26-11-2019 at 6.30 p.m. the 2nd respondent/complainant who is the resident of Kodiwadi village was in his house. A car stops in front of the house and when he goes near the car, he noticed accused Nos.1, 2 and 3 in the car, at that time, accused No.1 shot the complainant twice with an intent to kill him with his pistol resulting in grave injury to the complainant, on his left chest and blood injury to the right eye. He was treated at the hospital. The reason for the said incident was said to be the dispute between the complainant and one Kore Umar regarding compromise of a particular case. Based upon the said incident, a complaint comes to be registered on 26-11-2019 which becomes a crime in Crime No.125 of 2019 initially for offences punishable under Sections 447, 307 and 34 of the IPC and Sections 3 and 25 of the Indian Arms Act. The police conduct investigation and file a charge sheet. 8. It transpires that a split charge was drawn and against accused Nos.3 and 6 the offences under the Indian Arms Act were dropped. As observed hereinabove, the petitioner was later drawn into the charge sheet as accused No.5. The offences had a different colour while filing the charge sheet. The charge sheet was filed for the offences under Sections 447, 326, 324, 307, 120B, 109 and 201 of the IPC as against accused Nos.1, 2 and 3, accused Nos.4 and 5 are charge sheeted for the offence under Section 120B and 34 of the IPC and accused No.6 is charge sheeted for the offence under Section 109 of the IPC and Sections 3(1) and 25(1A) of the Indian Arms Act, 1959. The concerned Court takes cognizance of the aforesaid offences and commits the matter to the Court of Sessions. The Sessions Court later, registers S.C.No.5002 of 2023. 9. The issue now would be, whether the petition should be entertained on the solitary score that there is no evidence against the petitioner, except the statement of accused No.1? 10. It therefore becomes necessary to notice the statement of the complainant on the date of commission of the offence, it reads as follows: “ೇೆ :- ೆ. ಪNವ ಾ<ೇOನ ಸೂ, Pೇ ಾಯಕಮದA* ಹ@ೇ ?ಾKL ಸಂಘದ ಖSಾಂTUಾI ಾ<ೊVಂಡು ಮWಾKಹCದ ಊಟವನುC Zಾ<ೆಯA*[ೕ ಮುI>ೆ ಸಂSೆ ಸು\ಾರು 5-00 ಗಂ^ೆ1ೆ ಮ-ೆ ಕPೆ1ೆ ೊರಡು6ಾ4 ಾ<ೇOನ ಹB4ರ?ರುವ >_`#ಂa ಪN ನA* bಾCನ \ಾ/ ಅA*ಂದ 7ೕ^ಾರು bೈಕ ನA* ಮ-ೆ ಕPೆ1ೆ ೊರಡು'ಾಗ ಸಂSೆ 5.45 ಗಂ^ೆ1ೆ ನನC bೆCೕfತ ಮ-ೆ ಹB4ರ ಅಬು ಹ`ೕ$ ಮ-ೆ1ೆ gೕh \ಾ/ iನC ಮ-ೆಯ ಬ ಅಪMTತ ಾರು ಒಂದು ಸು6ಾ4ಡುB4ೆ. ನಮ# ಮ-ೆಯA* ಈ 9ನ lಾB ಹರೆ ಾಯಕಮ ಇದುದMಂದ ನನC ಮ-ೆಯA* ತಂI ರಹಮq, ಅಣs ಸು<ೈ\ಾh ರವರ ಪBC ನ>ೕ\ಾ, ಅಣsನ ಮಗ tಾ>ೕq ರವರು ಇದರು. ಾಯಕಮ ಇದ ಾರಣ ಮ-ೆ ಸುತ4 ?ದುKq uೆಳಕು ಾwದರು fೕIರು6ಾ4 ಸಂSೆ ಸಮಯ ಸು\ಾರು 6-30 ಗಂ^ೆ ಸಮಯೆ, bೆCೕfತ ಅಬು ಹ`ೕ$ B>ದ ಅಪMTತ y ಬಣsದ ಇಂ/ಾ ಾlೊಂದು ಉಮ# ರವರ ಮ-ೆಯ ಕPೆzಂದ ಬಂದು -ೇರ'ಾI ನನC ಮ-ೆಯ ಅಂಗಳೆ ಬಂದು BರುI \ಾಗದ ಕPೆ1ೆ ಮುಖ \ಾ/ iಂBತು. ಸ9 ಾMನ 1ಾ*{ ಪNB uಾ*| ^ೆಂ} ಇದುದMಂದ ಾMನA*ರುವವರು Uಾlೆಂದು BಯAಲ* ಾMನ ಬ1ೆ ೋೆನು. ಆ ಸಮಯ ಾMನ ಮುಂ9ನ ಎಡಬ9ಯ 1ಾ*{ 6ೆlೆzತು. ಾMನ tಾಲಕ >ೕ~ನA* bಾ•ೕ| Uಾ-ೆ ¨ÉèÀ bಾ•| ಇದು ಪಕ,ದ >ೕ~ನA* ಪMಚಯದ ಶ`ೕ Uಾ-ೆ ಚ`# Uಾ-ೆ Pೆ/* ಎಂuಾತ ಇದನು. fಂ9ನ >ೕ~ನA* ನನ1ೆ -ೋ/ ಪMಚಯ?ರುವ ಇವರು ಮತು4 ಹiೕƒ ಎಂಬುವರು ಇದರು. tಾಲಕನ >ೕ~ನA* ಕುBದ bಾ•ೕ| Uಾ-ೆ ¨ÉèÀ bಾ•ೕ| ಏಾಏw ಾMನ ಎಡಬ9ಯ wಟwಯ ಬ9ಯA* iಂBದ ನನC ಎೆ1ೆ … ಅಷoರA* bಾ•ೕ| ನು ಮ6ೊ4ಂದು ಸುತು4 ಗುಂಡನುC ನನCತ4 ಾM>ದು ಅದು ನನC ಬಲ ಕ=sನ ಬ91ೆ 6ಾIತು. ೆ†.-12-ಎƒ.ಜ€ 1069 ಆIತು4. ಈ ಘಟ-ೆಯನುC -ೋ/ದ ಅA*ದ ನನC ಪBC, ತಂI, ಅಣsನ ೆಂಡB, ಅಣsನ ಮಗ 1ಾಬM1ೊಂಡು uೊuೆŠ ಾwದರು. ಆ ಬಕ -ಾನು ನನC ಾMನA* -ಾ-ೇ tಾಲಕ-ಾI, ಪಕ,ದ >ೕ~ನA* ಅಣsನ ಮಗ uಾ>ೕತನನುC ಕುಳ‹M> ೊಂಡು ಕ®ಕೆ, ಬಂೆನು. ಬರು6ಾ4 ನಮ# ಅಬೂಬŠಕ, i1ೆ gೕh \ಾ/ ಘಟ-ೆ ?tಾರ B>ದು ಆತನು ಕಬಕದA*ದು ಅA*ಂದ ನನ1ಾದ 1ಾಯದ Tw6ೆŒಯ ಬ1ೆV ೋಗು6ಾ4 tಾಲಕ-ಾI ತಮ# ಅಬೂಬŠಕ, ನು ಕುತನು. -ಾನು fಂ9ನ >ೕ~ನA* ಕುತು ಪ3ತೂ4ರು ಪಗB ಆಸ06ೆ1ೆ ಬಂೆವ3. ಅA* 'ೈದKರು ನನ1ಾದ 1ಾಯವನುC -ೋ/ ಕೂಡ<ೇ ಮಂಗಳHರು ಆಸ06ೆ1ೆ ಕlೆದುೊಂಡು ೋಗುವಂ6ೆ B>ದರು. ಅದರಂ6ೆ ಅA*ಂದ ನನC •ಾವ >lಾŽ ರವರ ಾMನA* ಮಂಗಳHMನ ಇಂ/ಯ-ಾ ಆಸ06ೆ1ೆ ಬಂದು ಾಖ<ಾIದು Tw6ೆŒ iೕ/ದ 'ೈದKರು ಶಸ• Tw6ೆŒ1ಾI ನನCನುC ಒಳlೋIಯ-ಾCI ಾಖಲು \ಾ/ೊಂ/ರು6ಾ4lೆ. ರುದ ದೂರು iೕ/ದು, ಪಕರಣವ3 -ಾKUಾಲಯದA* ?tಾರ•ೆಯA*ರುತ4ೆ. ಶ`ೕ Uಾ-ೆ ಚ`# ಎಂuಾತನು ನನCನುCೇD> ನನCA* ೆ_ೕಷ9ಂದ ಎರಡು 9ವಸದA* iನCನುC ಮುIಸು6ೆ4ೕ-ೆ ಎಂದು uೆದM> ೋIದನು. ಈ MೕB ೆ_ೕಷ1ೊಂಡ ಆlೋ…ಗಳ‘ ಈ 9ನ ನನ1ೆ ಗುಂಡು ಾM> ೊ<ೆ1ೆ ಪಯBC>ದು ಆlೋ…ಗಳ ?ರುದ” ಸೂಕ4 ಾನೂನು ಕಮ ಜರುIಸ uೇಾI ೇೊಳ‘‹6ೆ4ೕ-ೆ.” ಓದ<ಾI ಸMzೆ. ಸf/- The police, on filing of the charge sheet has drawn the petitioner as accused No.5. Accused Nos.4 and 5 are actively involved in hatching the conspiracy, as meeting of minds is clear in the case at hand. The matter is at the stage of framing of charges. Finding the issue being shrouded with maze of facts, entertainment of a petition under Section 482 of the Cr.P.C., at this stage, in the teeth of the aforesaid offences, would run foul of the judgment of the Apex Court in the case of KAPTAN SINGH v. STATE OF UTTAR PRADESH1 wherein it is held as follows: “9.1. At the outset, it is required to be noted that in the present case the High Court in exercise of powers under Section 482 CrPC has quashed the criminal proceedings for the offences under Sections 147, 148, 149, 406, 329 and 386 IPC. It is required to be noted that when the High Court in exercise of powers under Section 482 CrPC quashed the criminal proceedings, by the time the investigating officer after recording the statement of the witnesses, statement of the complainant and collecting the evidence from the incident place and after taking statement of the independent witnesses and even statement of the accused persons, has filed the charge- sheet before the learned Magistrate for the offences under Sections 147, 148, 149, 406, 329 and 386 IPC and even the learned Magistrate also took the cognizance. From the impugned judgment and order [Radhey Shyam Gupta v. State of U.P., 2020 SCC OnLine All 914] passed by the High Court, it does not appear that the High Court took into consideration the material collected during the investigation/inquiry and even the statements recorded. If the petition under Section 482 CrPC was at the stage of FIR in that case the allegations in the FIR/complaint only are required to be considered and whether a cognizable offence is disclosed or not is required to be considered. However, thereafter when the statements are recorded, evidence is collected and the charge-sheet is filed after conclusion of the investigation/inquiry the matter stands on different footing and the Court is required to consider the material/evidence collected during the investigation. Even at this stage also, as observed and held by this Court in a catena of decisions, the High Court is not required to go into the merits of the allegations and/or enter into the merits of the case as if the High Court is exercising the appellate jurisdiction and/or conducting the trial. As held by this Court in Dineshbhai Chandubhai Patel [Dineshbhai Chandubhai Patel v. State of 1 (2021) 9 SCC 35 Gujarat, (2018) 3 SCC 104 : (2018) 1 SCC (Cri) 683] in order to examine as to whether factual contents of FIR disclose any cognizable offence or not, the High Court cannot act like the investigating agency nor can exercise the powers like an appellate court. It is further observed and held that that question is required to be examined keeping in view, the contents of FIR and prima facie material, if any, requiring no proof. At such stage, the High Court cannot appreciate evidence nor can it draw its own inferences from contents of FIR and material relied on. It is further observed it is more so, when the material relied on is disputed. It is further observed that in such a situation, it becomes the job of the investigating authority at such stage to probe and then of the court to examine questions once the charge-sheet is filed along with such material as to how far and to what extent reliance can be placed on such material. 9.2. In Dhruvaram Murlidhar Sonar [Dhruvaram Murlidhar Sonar v. State of Maharashtra, (2019) 18 SCC 191 : (2020) 3 SCC (Cri) 672] after considering the decisions of this Court in Bhajan Lal [State of Haryana v. Bhajan Lal, 1992 Supp (1) SCC 335 : 1992 SCC (Cri) 426] , it is held by this Court that exercise of powers under Section 482 CrPC to quash the proceedings is an exception and not a rule. It is further observed that inherent jurisdiction under Section 482 CrPC though wide is to be exercised sparingly, carefully and with caution, only when such exercise is justified by tests specifically laid down in the section itself. It is further observed that appreciation of evidence is not permissible at the stage of quashing of proceedings in exercise of powers under Section 482 CrPC. Similar view has been expressed by this Court in Arvind Khanna [CBI v. Arvind Khanna, (2019) 10 SCC 686 : (2020) 1 SCC (Cri) 94] , Managipet [State of Telangana v. Managipet, (2019) 19 SCC 87 : (2020) 3 SCC (Cri) 702] and in XYZ [XYZ v. State of Gujarat, (2019) 10 SCC 337 : (2020) 1 SCC (Cri) 173] , referred to hereinabove. 9.3. Applying the law laid down by this Court in the aforesaid decisions to the facts of the case on hand, we are of the opinion that the High Court has exceeded its jurisdiction in quashing the criminal proceedings in exercise of powers under Section 482 CrPC. 10. The High Court has failed to appreciate and consider the fact that there are very serious triable issues/allegations which are required to be gone into and considered at the time of trial. The High Court has lost sight of crucial aspects which have emerged during the course of the investigation. The High Court has failed to appreciate and consider the fact that the document i.e. a joint notarised affidavit of Mamta Gupta Accused 2 and Munni Devi under which according to Accused 2 Ms Mamta Gupta, Rs 25 lakhs was paid and the possession was transferred to her itself is seriously disputed. It is required to be noted that in the registered agreement to sell dated 27-10-2010, the sale consideration is stated to be Rs 25 lakhs and with no reference to payment of Rs 25 lakhs to Ms Munni Devi and no reference to handing over the possession. However, in the joint notarised affidavit of the same date i.e. 27-10-2010 sale consideration is stated to be Rs 35 lakhs out of which Rs 25 lakhs is alleged to have been paid and there is a reference to transfer of possession to Accused 2. Whether Rs 25 lakhs has been paid or not the accused have to establish during the trial, because the accused are relying upon the said document and payment of Rs 25 lakhs as mentioned in the joint notarised affidavit dated 27-10-2010. It is also required to be considered that the first agreement to sell in which Rs 25 lakhs is stated to be sale consideration and there is reference to the payment of Rs 10 lakhs by cheques. It is a registered document. The aforesaid are all triable issues/allegations which are required to be considered at the time of trial. The High Court has failed to notice and/or consider the material collected during the investigation. 11. Now so far as the finding recorded by the High Court that no case is made out for the offence under Section 406 IPC is concerned, it is to be noted that the High Court itself has noted that the joint notarised affidavit dated 27-10-2010 is seriously disputed, however as per the High Court the same is required to be considered in the civil proceedings. There the High Court has committed an error. Even the High Court has failed to notice that another FIR has been lodged against the accused for the offences under Sections 467, 468, 471 IPC with respect to the said alleged joint notarised affidavit. Even according to the accused the possession was handed over to them. However, when the payment of Rs 25 lakhs as mentioned in the joint notarised affidavit is seriously disputed and even one of the cheques out of 5 cheques each of Rs 2 lakhs was dishonoured and according to the accused they were handed over the possession (which is seriously disputed) it can be said to be entrustment of property. Therefore, at this stage to opine that no case is made out for the offence under Section 406 IPC is premature and the aforesaid aspect is to be considered during trial. It is also required to be noted that the first suit was filed by Munni Devi and thereafter subsequent suit came to be filed by the accused and that too for permanent injunction only. Nothing is on record that any suit for specific performance has been filed. Be that as it may, all the aforesaid aspects are required to be considered at the time of trial only. 12. Therefore, the High Court has grossly erred in quashing the criminal proceedings by entering into the merits of the allegations as if the High Court was exercising the appellate jurisdiction and/or conducting the trial. The High Court has exceeded its jurisdiction in quashing the criminal proceedings in exercise of powers under Section 482 CrPC. 13. Even the High Court has erred in observing that original complaint has no locus. The aforesaid observation is made on the premise that the complainant has not placed on record the power of attorney along with the counter filed before the High Court. However, when it is specifically stated in the FIR that Munni Devi has executed the power of attorney and thereafter the investigating officer has conducted the investigation and has recorded the statement of the complainant, accused and the independent witnesses, thereafter whether the complainant is having the power of attorney or not is to be considered during trial. 14. In view of the above and for the reasons stated above, the impugned judgment and order [Radhey Shyam Gupta v. State of U.P., 2020 SCC OnLine All 914] passed by the High Court quashing the criminal proceedings in exercise of powers under Section 482 CrPC is unsustainable and the same deserves to be quashed and set aside and is accordingly quashed and set aside. Now, the trial is to be conducted and proceeded further in accordance with law and on its own merits.
