Sinha, A.P.P -------- 02/ Dated 18.11.2025 Heard the parties. The petitioners have been made accused in connection with Jaridih P.S. Case No. 105 of 2025, for the offence under Sections 303(2), 317(2) & 3(5) of B.N.S., Section 21 of MMDR Act, Rule 54 of JMMC Rules, 2004 and Rule 13 of the Jharkhand Minerals (Prevention of Illegal Mining, Transportation and Storage) Rules, pending in the court of learned ACJM, Bermo at Tenughat. Petitioners are the drivers of the trucks, which were seized by the Jaridih Police on 10.09.2025, loaded with illegal coal. It was submitted that petitioners were transporting the seized coal at the instance of the owner of the vehicles. It was further submitted that petitioners have got no criminal antecedent. It was also submitted that the chargesheet has been submitted in this case and the offence alleged is triable by the Court of Judicial Magistrate. In view of the submission made above, I am inclined to release the petitioners, on bail. Accordingly, the petitioners, named above, are directed to be released on bail on furnishing bail bonds of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each, to the satisfaction of learned ACJM, Bermo at Tenughat, in connection with Jaridih P.S.
