3. Present applicant–Syyed Moazzam Ali, is seeking bail in relation to first information report dated 09.10.2024 bearing FIR No. 0193 of 2024, Police Station Laalkaun, District Nainital, wherein one Shivam Verma was implicated for the offences punishable under Sections 179 and 180 of BNS 2023.

Learned counsel for the applicant submits that the present applicant is not named in the FIR and the applicant has no previous criminal history and no recovery has been made from the present applicant and he has been arrested on the basis of the statement of other co-accused which is not admissible.

Per Contra, learned State Counsel Mr. Sandeep Sharma, on written instruction, submits that though the present applicant is not named in the FIR, but during investigation, it has been found that the applicant was associated with five other persons, who were indulged in this crime. Apart from this, he submits that not only this, fake currency of an amount of Rupees Four Lakh, they bring from West Bengal with an intention to use in the State of Uttarakhand.
6. After hearing the
arguments as advanced by learned counsel for the parties and further taking into consideration as
2025:UHC:2287 well as the submission as advanced by the State counsel, which is based upon the written instruction, this Court is of the view that the applicant is not deserves to be enlarged on bail.
7. Accordingly, the bail application is rejected.
