GP FOR HOME 3 THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA WRIT PETITION NO: 25722 of 2025 ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “…pleased to issue an appropriate writ, order or direction, more particularly a Writ in the nature of Mandamus, declaring the action of the respondents especially Respondent No. 4 and 5 herein in calling the petitioner to the police station and forcing the petitioner to settle Civil Disputes and forcing petitioner to withdraw the pending suit vide O.S.No. 42 of 2025 on the file of Honble Junior Civil Judge, Dharmavaram and hand over the possession of the land to an extent of Ac. 1.28 cents in Sy. No. 403 - 3B and Ac. 3.22 cents in Sy.No. 403 - 5B, Total extent Ac. 4.50 cents, situated in Nyamaddala village, C.K.Palli Mandal, Sri Sathya Sai District to the unofficial respondents herein and to act as per the terms of unofficial respondent as being arbitrary, illegal and violation of Article 14, 19, 21 and 300-A of Constitution of India apart from violative of Principles of Natural Justice, apart from various judicial pronouncements of this Honble Court as well as the Honble Apex Court and consequently direct the Respondent No. 4 and 5 herein not to call the petitioner to the police station without there being any crime registered against the petitioner and not to interfere in Civil Disputes pending between petitioner and the unofficial respondents and to pass….” 2. Heard Sri V.Nitesh, learned counsel for the petitioner and Sri V.Farooq, learned Assistant Government Pleader for Home for the respondents. 3. Learned counsel for the petitioner would submit that police are calling the petitioner to the police station without there being any crime registered against him and forcing the petitioner to settle civil disputes between the petitioner and the unofficial respondents. 4 4. Learned Assistant Government Pleader for Home for the respondents, on written instructions would submit that the respondent police never called the petitioner to the police station and never forced the petitioner to settle civil disputes between the petitioner and the unofficial respondents. 5. Considering the submissions, the Writ Petition is disposed of. However, the police are directed not to call the petitioner to the police station in absence of any crime registered against him. The police are further directed not to interfere in the civil disputes between the parties by calling the petitioner to the police station and pressuring him to settle the pending civil suit. There shall be no order as to costs.
