(ORAL) The instant petition has been preferred by the petitioner under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of anticipatory bail in the following case (Annexure P-1):- FIR No. Dated Sections Police Station 516 22.11.2023 406, 420, IPC Sector-17, HUDA, Jagadhri, District Yamuna Nagar o. 2), Mo 2. Arguments heard. 3. It is inter alia contended by learned counsel for the petitioner that the petitioner is innocent and has been falsely implicated in this case. He contends that complainant Nanu Singh had played mischief with the petitioner for his own benefits and infact the complainant had usurped the amount. Hence prays for grant of concession of anticipatory bail to the petitioner. 4. Per contra, learned State counsel assisted by SI Satpal, Investigating officer of the case, referring to the reply submitted by the State has opposed the bail petition on the ground that petitioner had usurped an ₹ amount of 19,37,401/- from the complainants by aluring them on the pretext of providing Job in Sugar Company in Nigeria and issued fake offer letters by using letter pad of Turbotech Engineers company (Annexure R-3 ₹ to R-7). He submits that during investigation, it is found that 12,67,000/- were transferred in the account of the petitioner (Annexure R-2) and ₹5,57,000/- were taken as cash from the complainants, in total petitioner had ₹ usurped 18,24,000/-, He contends that to recover the amount as well as the source of forged and fabricated offer letters, custodial interrogation of the petitioner is required. Hence prayed for dismissal of the bail petition. 5. After considering the rival contentions and perusing the record, it transpires that FIR was registered on the complaint of Nanu Singh etc. to the effect that Varun Rawat is working with Turbotech Engineers and one of the complainant i.e. Nanu Singh was also working in the aforesaid Company but had left the Company in the year 2022 and started working at Maruti Service Station, Yamuna Nagar. In the month of April 2023, petitioner made a telephonic call to him stating that his company is getting employment for employed persons by sending them to Nigeria where salary ₹ of about 1,80,000/- per month would be given. After some time, petitioner came to Yamuna Nagar and stayed in a hotel near Pandit Automobiles and Gyan Chand 2025.05.15 17:39 I attest to the accuracy and integrity of this document CRM-M-15010-2024 -3- called he complainant and his companions in Hotel and told that that their company is sending people to Nigeria and gave assurance that they will be ₹ employed in Dongote Super Refinery and an amount of 50,000/- to ₹1,50,000/- would be charged as security amount and later on the said amount would be returned. All the complainants believing the words of the petitioner collected ₹ 19,37,401/.- through Complainant Nanu Singh, Shubham and Rajnish and paid to the petitioner and the petitioner issued offer letters on the letter pad of Turbotech Engineers company bearing amount of salary and dates of joining. Thereafter, the petitioner also ₹ collected 23,000/- on the pretext of belt/injections and amount was transferred from bank account of Nitin, Adhay Parsad etc. Thereafter, petitioner called them to Delhi/Noida and stayed in hotel for two days, when petitioner did not fulfill assurances, complainants demanded their money back, however, petitioner extended threats to them and not returned the money. On these, allegations FIR was registered. 6. It is evident from the record that vide letter dated 01.02.2024 (Annexure R-1) of Turbotech Engineers, the petitioner had worked there till 23.05.2023, thereafter he was terminated from his duties. After his termination from the company, the petitioner had created fake Letter Head, Stamp and some agreement papers by forging signatures on the letters issued to the complainants. It is also evident from the perusal of account statement of the petitioner that complainants had allegedly paid money to him (Annexure R-2). Therefore, considering the nature and gravity of offence, no case is made out in favour of the petitioner for grant of concession of anticipatory bail, as a consequent, the petition is hereby dismissed. 7.
