HIGH COURT OF JUDICATURE AT ALLAHABAD WRIT - A No. - 56199 of 2006 Court No. - 5 HON'BLE SAURABH SHYAM SHAMSHERY, J.
1. Heard Sri R.C.Tiwari holding brief of Sri Diwakar Prasad Tiwari, learned counsel for the petitioner and Sri Sumit Kakkar holding brief of Sri Satish Kishore Kakkar, learned counsel for the respondents.
2. This writ petition is pending for the last 19 years, therefore, not only claim of the petitioner for compassionate appointment has become infructuous, but has also lost an opportunity for applying for ex-gratia compensation under the Scheme offered by impugned order, since now it has become meaningless considering that now the petitioner is more than 60 years.
3. Learned counsel for the petitioner has tried to make out a case of ex- gratia compensation, however, as referred above, it cannot be considered at this belated stage, accordingly, this writ petition is dismissed.
