Heard the parties.
The petitioner has been made accused in connection with Complaint Case No. 3207 of 2025, for the offence registered under Sections 132(1)(b), 132(1)(c), 132(1)(f) and 132(1)(1) & 132(5) of the Central Goods and Service Tax Act, 2017 and Sections 61, 316 & 322 of the B.N.S., 2023, pending in the court of Sri Abhishek Prasad, learned Special Judge, Economic Offences, Jamshedpur.
Petitioner is alleged to have evaded GST worth Rs. 31.00 crores for different financial years.
It was submitted that the prosecution report has been submitted in this case. It was further submitted that the maximum punishment for evasion of GST is five years and the petitioner has remained in custody for almost three months.
Mr. P.A.S. Pati, learned counsel appearing on behalf of the Director General of GST Intelligence, submitted that the petitioner is the main master mind of evasion of GST.
Considering the period of custody, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of Sri Abhishek Prasad, learned Special Judge, Economic Offences, Jamshedpur, in connection with Complaint Case No. 3207 of 2025.
