The grievance of the appellant in the present Writ Appeal is that even when it had figured as respondent No.6 in the Writ Petition filed by the petitioners/respondent Nos.6 to 19 herein, no notice was issued and the matter was disposed of with directions against the appellant Society to admit the petitioners into the Society.

Learned counsel for the private respondents/petitioners does not deny the fact that no notice was issued to the appellant Society in the writ petition while finally disposing off the matter.

3. Be that as it may, we allow the writ appeal and remand the matter back to the learned Single Judge for consideration afresh on merits. The appellant shall be at liberty to file its response on or before the next date of hearing. Registry is directed to post W.P.No.28156 of 2023 before the learned Single Judge having Roster on 07.10.2025.
No order as to costs. Pending miscellaneous applications, if any, in this case, shall stand closed.
