Respondent Petition under Section 437 & 439 of Cr.P.C/ 480 & 483 of BNSS., is filed praying that in the circumstances stated in the grounds filed in support of the CriminalPetition, the High Court may be pleased to enlarge the Petitioner/A.4 on Regular Bail in connection with Crime No. 114/2021 of Krishnadevipeta Police Station, Anakapalli District, dt. 10.08.2021. The petition coming on for hearing, upon perusing the Petition and the affidavit filed in support thereof and upon hearing the arguments of Dr ANWAR SHAIK, Advocate for the Petitioner and of PUBLIC PROSECUTOR, for the Respondent; The Court made the following ORDER: 2 ORDER: This criminal petition has been filed, under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, seeking to enlarge the petitioner- accused No. 4 on bail in crime No. 114 of 2021 of K.D.Peta Police Station, Visakhapatnam District, registered for the offences punishable under Sections 20 (b) (ii) (C) and 25 read with Section 8 (c) of the Narcotic Drugs and Psychotropic Substances Act, 1985, on the allegation of the petitioner- accused No. 4 had indulged in dealing with 21 K.Gs. of Ganja with the help of other accused.' 2. Heard learned counsel for the petitioner-accused No. 4 and learned Assistant Public Prosecutor appearing for the respondent-State. 3. The case was registered as crime No. 114 of 2021 of K.D.Peta Police Station. The petitioner ever since registration of the crime was absconding. Against the other accused, investigation was completed and charge sheet was filed and the same was numbered as NDPS S.C.No. 302 of 2023. The allegation against the petitioner-accused No. 4 is that with the help of other accused, he had indulged in dealing with 21 K.Gs. of Ganja. Inventory was completed. This Court, in Criminal Petition No. 9019 of 2025 on 09-09-2025 enlarged accused No. 1 on bail on the point that investigation was completed and charge sheet was filed. The petitioner was arrested on 04-05-2025. He has been in judicial custody for the past 164 days. 3 4. Considering the facts and circumstances of the case and the nature and gravity of allegations levelled against the petitioner-accused No. 4, this Court is inclined to enlarge him on bail with the following stringent conditions: The petitioner-accused rio. 4 shall be enlarged on bail subject to his executing a bond for a sum of Rs. 1,00,000/- (Rupees one lakh only) with two sureties for the like sum each to the satisfaction of learned I Additional District and Sessions Judge - cum - Special Judge for Trial of Offences under NDPS Act, Visakhapatnam; (i) (ii) The petitioner-accused No. 4 shall not cause any threat inducement or promise to the prosecution witnesses; and (iii) The petitioner-accused No. 4 shall surrender his passport, if any, to the investigating officer. If he claims that he does not have passport, he shall submit an affidavit to that effect to the Investigating Officer; and (iv) The petitioner-accused No. 4 shall not leave the limits of Andhra Pradesh State without the express permission from the Station House Officer concerned. 5. The criminal petition is accordingly allowed.
