The accused/applicants have moved this first bail application under Section 483 of BNSS, 2023 for releasing them on regular bail during trial in connection with Crime No. 75/2025 registered at Police Station – Sarangarh, Digitally signed by HEERA LAL SAHU Date: 2025.07.22 11:27:47 +0530 2 District – Sarangarh-Bilaigarh (C.G.) for the offence punishable under Sections 296, 191(2), 191(3), 190, 109 and 103(1) of B.N.S. and Sections 25 & 27 of Arms Act. 2. As per the prosecution’s case, it is alleged that on 13.02.2025, the applicants used filthy language in front of the shop of complainant Salman Ansari and at the same time, one boy came there with having stick and assaulted the complainant. It is also alleged that the applicant and other co-accused persons assaulted the complainant using filthy language, and one co-accused fired with a pistol, due to which Mukhlal Manjhi sustained a bullet shot on his chest and died. Complainant Salman Ansari also sustained grievous injuries in the said assault. Based on this, offence has been registered against the present applicants along with other co-accused persons. 3. Learned counsel for the applicants submits that the applicants have been falsely implicated in the present case. He also submits that the main allegation is against the co- accused Krishna Rajput, there is no seizure from the present applicants. The applicants are women and are in jail since 14.02.2025, and there is no likelihood of their case being decided in the near future, therefore, the present applicants may be released on bail. 3 4. On the other hand, learned counsel for the State opposes the bail application and submits that there are 5 eyewitnesses in this case. The applicants committed the alleged offence along with other co-accused persons with a common intention, and the trial has not commenced yet; therefore, at this stage, they may not be enlarged on bail. 5. I have heard learned counsel for the parties and perused the case diary. 6. Considering the entire facts and circumstances of the case, particularly looking to the material available on record, the evidence collected by the prosecution against the applicants, the gravity of the offence and the trial has not commenced yet, at this stage, I am not inclined to release the applicants on bail. Accordingly, the bail application filed under Section 483 of BNSS, 2023, is rejected. 7.
