As per the prosecution story, on 10.04.2025, Gandhinagar Police Station received a report from the additional Superintendent of Police Cyber Cell Ambikapur, regarding a cyber fraud case involving an account held at IDBI Bank, Ambikapur branch and the account belongs to Vinod Pradhan, allegedly linked to multiple online fraud complaints from various states, with sum amount of Rs. 206,962/- thus case has been registered under Sections 317(4), 318(4) & 61(2)A of the Bhartiya Nyaya Sanhita, 2023 and legal action has been initiated against the account holder. Accordingly, the applicant stands accused of involvement in the aforementioned crime. 3. The applicant has been falsely implicated in the said crime after being misled by his neighbor, Rahul Singh, who convinced him to open an online gaming account by claiming he needed the applicant’s bank documents for loan processing. Trusting him, the applicant handed over the documents, which were later misused without his knowledge or consent. The applicant never withdrew any amount from the account; all transactions were independently carried out by Rahul Singh, who is already in custody as the main accused. The applicant is thus a victim of a well-planned conspiracy, has clean antecedents with no prior criminal record, and being a permanent resident of Village Koltapara, Navanagar, P.S. & Tehsil Darima, District Surguja (C.G.), there is no risk of absconding or tampering with evidence. He further submits that applicant is in jail since 19.06.2025, Therefore, he prays for grant of regular bail to the applicant. 4. On the other hand, the learned State counsel opposes the submission made by the learned counsel for the applicant and submits that the 3 present applicant along with other co-accused persons committed online fraud of Rs. 206,962/-, therefore, he is not entitled for grant of regular bail in the present case. 5. I have heard learned counsel for the parties and perused the case diary. 6. Considering the nature and gravity of the offence and also considering the fact that the applicant has committed a cyber fraud involving an account held in IDBI Bank, Ambikapur and further committed a fraud of Rs. 206,962/-, thus, looking to the seriousness of the allegations against the present applicant, I am not inclined to grant regular bail to the applicant. 7. Accordingly, the bail application of the applicant – Vinod Pradhan, involved in Crime No. 235/2025, registered at Police Station – State of Chhattisgarh, Through : Thana Gandhi Nagar District – Surguja (C.G.) for the alleged commission of offence punishable under Sections 317(4), 318(4) & 61(2)A of the Bhartiya Nyaya Sanhita, 2023, is rejected.
