This is the first bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No. 235/2025 registered at Police Station City Kotwali Bilapur, District – Bilaspur (C.G.), for the offence punishable under Sections 318(4) & VAIBHAV SINGH Digitally signed by VAIBHAV SINGH Date: 2025.07.09 14:22:03 +0530

As per the impugned order the facts of the case is that on 28.04.2025 applicant and co-accused Suman shriwas went to shop of complainant namely Soni Himmat Lal Khushal Bhai and Brothers Jewelers Sadar Bazar Bilaspur and in fraudulently manner presenting duplicate gold ornament as original and received original gold ornament 42.3 Gram amounting of Rs. 441572 and cash of Rs. 13572 and committed forgery with the complainant. As per the said report crime is registered against the applicant. 3. Learned counsel for the applicant would submit that the applicant has been falsely implicated in this case. He submits that according to the proseuction the applicant gave duplicate gold ornament and received original ornament however complaint clearly written that offence was committed by Suman Srivastava and all things recorded in CCTV footage but in charge -sheet there is no any photographs and CCTV footage is mentioned and applicant was not present in the spot and she is also not visible in any photographs and CCTV footage but deliberately name of applicant is involved in this case and she is in jail since 30.04.2025, conclusion of the trial may take some time, therefore, she prays for grant of regular bail to the applicant. 4. The learned counsel for the State/non-applicant opposes the bail application and submitted that there are two criminal cases against the applicant, hence, the applicant is not entitled for grant of regular bail. 5.
I have heard learned counsel appearing for the parties and perused the case diary. 6. Considering the facts and circumstances of the case, the nature
3 and gravity of the offence, the material available in the case diary, and the fact that the applicant committed theft by presenting duplicate gold ornaments as original and received genuine gold ornaments weighing 42.3 grams, amounting to 4,41,572/-, and ₹
has two prior criminal antecedents, therefore, this is not a fit case to grant regular bail to the applicant. 7. Accordingly, the bail application of the applicant - Smt. Malti Soni involved in Crime No. 235/2025 registered at Police Station City Kotwali Bilapur, District – Bilaspur (C.G.), for the offence punishable under Sections 318(4) & 3(5) of the Bhartiya Nyaya Sanhita, 2023, is rejected. 8. Office is directed to send a certified copy of this order to the trial Court concerned for necessary information and compliance forthwith. - Sd/-
