Jagdeep Brar & Ors. Vs. M/s. Homestead Infrastructure Development & Ors. CS No. 115 of 2019 25.11.2025 Present : Mr. Jeevesh Sharma, Advocate, for the plaintiff. Mr. Rajan Kahol, Advocate, for defendants No.2, 3, 5 and 6. Despite various opportunities, steps for service upon Defendants No. 1 and 4 by way of publication have not been taken. On 21.08.2025, the following order was passed:- “The plaintiff has failed to take steps for the service of defendants No. 1 and 4 by way of publication despite repeated opportunities. At the persuasive submission of learned counsel for the plaintiff, one last opportunity is afforded and accordingly is directed to take steps in terms of previous orders within four weeks, failing which, the suit shall stand dismissed for non-prosecution. List on 25.11.2025.” Even today, the report of the Registry reveals that the plaintiff has not taken any steps for service upon Defendants No. 1 and 4. In these circumstances, this Court is left with no option but to dismiss the suit for non-prosecution; hence, the present suit is dismissed for non-prosecution.
