The Court made the following Order: The petitioner is challenging the unilateral action of the respondents in orally instructing her not to attend duties. 2. It is submitted by the learned counsel for the petitioner that the service of the petitioner was terminated by relying upon a press release alleging misappropriation. No enquiry was conducted, and the petitioner was informed not to attend duties by the respondents. The petitioner was engaged in October 2011 for distributing pensions under NREGS Scheme through the Smart Card system. 2 3. The respondents, in their counter-affidavit, submit that the petitioner was not engaged by the respondents, she was engaged by Access Bank, which was the service provider with an understanding of executing the workers’ distribution of pensions for the respondent through a service provider. The petitioner was paid the relevant wages by Access Bank and not by the State. 4. That apart, the system of distribution of pensions has now changed from distribution through smart cards to direct bank transfers during the pendency of the writ petition. As such, the cause in the writ petition would not survive any further. Accordingly, the writ petition is dismissed as infructuous. There shall be no order as to costs.
