The Court made the following ORDER: lIIIII- \b I ®| HON'BLE SRI JUSTICE K SREENIVASA REDDY Criminal Petition No.361 of 2025 QEha : This Criminal Petition, under Sections 480 and 483 of the BNSS, has been filed by the petitioner herein/A1, seeking regular bail, in crime No.218 of 2o24 of Kotananduru Police station, Kakinada District, registered for the offences punishable under sections 69 and 115(2) read with 3(5) of the BNS. 2. Case of the prosecution, in brief, iS that On 04.ll.2024, the defacto complainant filed a report before the police stating that she got married with one Nookaraju and they begot three children out of their wedlock. In the month of July, 2023, her husband died. Later, in the month of August, 2023, she went to pothuluru Village where Al developed acquaintance with her by making false promise to her that he would marry her. Later, Al frequently visited the house of the defacto complainant and made sexual intercourse with her with deceitful words. On coming to know that the defacto complainant was pregnant, A2 to A4 came to K.A,Mallavaram Village and beat her with hands and kicked w'lth legs and took Al with them. On 12.09.2024, the defacto complainant gave birth to a baby boy and she tried to inform the same to Al several times over phone but he did not respond. Hence, the present complaint. 3. Heard. Perused the record. 4. A perusal of the material on record goes to show that the petitioner had sexual 'lntercourse by saying deceitful words to the defacto complainant. Learned Assistant Public Prosecutor L` '\ E='= '.§ .=E I submitted that th-e,,husband of the defacto complainant expired and thereafter, the defacto complaI-nant had got acquaintance with A1. On the pretext of marryI-ng her, the accused had gone physical with the defacto complainant. The petitioner herein was arrested on 18.1112024 and since then he has been in J'udiCial custodyI According to prosecutl'on, as many as nI-ne witnesses were examined and RFSL report is pending. 5. In vl-ew of the fact that major porfjon of the investigation has been completed and in v,lew of the length of remand period of the petl-tioner, this court Its inclined to consider request of the PetI`tiOner herein for grant of bail. 6. Accordingly, the crimI-hal PetjtI'On is allowed.
