Order on Board 25/04/2026
1. By way of the present writ petition filed under Article 226 of the Constitution of India, the petitioner seeks a limited relief for expeditious disposal of his appeal pending before the Appellate Authority/Regional Director, Employees’ State Insurance Corporation, against the order dated 15.05.2023 passed by the Assistant Director (respondent No. 3).
2.
Learned counsel for the petitioner submits that the aforesaid appeal has been preferred under Section 45AA of the Employees’ State Insurance Act, 1948, challenging the order passed by respondent No. 3. Despite the lapse of considerable time since its filing, the appeal remains undecided. It is, therefore, prayed that an appropriate direction be issued to respondent No. 2/Appellate Authority to decide the said appeal within a stipulated timeframe.
3. Per contra, learned counsel appearing for respondents No. 1 to 4 submits that the appeal preferred by the petitioner is presently under consideration and shall be decided at the earliest.
4. I have heard learned counsel for the parties and carefully perused the material available on record.

5. Having regard to the submissions advanced and considering the limited nature of relief sought by the petitioner, this Court deems it appropriate to dispose of the present petition at this stage. Accordingly, respondent No. 2/Appellate Authority is directed to consider and decide the petitioner’s appeal filed under Section 45AA of the Employees’ State Insurance Act, 1948, as expeditiously as possible, preferably within a period of 60 days from the date of receipt of copy of this order. The petitioner shall extend full cooperation in the expeditious disposal of the appeal.
6. With the aforesaid observations and directions, the writ petition stands disposed of. Pending interlocutory application(s), if any, shall also stand disposed of. Sd/- (Amitendra Kishore Prasad) Shayna Judge
