ORDER: The instant Criminal Petition under Section 482 of the Code of Criminal Procedure, 1973^ has been filed, by the Petitioner/Accused, seeking quashment of the Proceedings against him in CC No.659 of 2022 on the file of the Court of Judicial First class Magistrate, Palasa, registered for the offences punishable under Sections 447, 427 and 506 IPC.
2. Heard Ms.K.Aruna, learned counsel for the Petitioner and Ms.K.Priyanka Lakshmi, learned Assistant Public Prosecutor appearing for respondent No. 1/State and Sri Sapthagiri Metta,
learned counsel for respondent No.2. Perused the material on record.
3. Learned counsel for the Petitioner would submit that Petitioner and respondent No.2 are residents of Palasa Kasibugga Municipality and they are living side by side houses and that the Petitioner obtained patta in 2005 by paying market value to the Government. Further, as a counter blast to the complaint given by the Petitioner, respondent No.2 created this vexatious litigation.
Learned counsel would submit that except bald and omnibus allegations, no specific overt acts are attributed against him. Learned counsel restricted the prayer and requested to dispense with the presence of the Petitioner before the Trial Court on the dates of adjournments.
4. Learned Assistant Public Prosecutor would submit that the Court may pass appropriate orders. . For short ‘the Code’

5. Considering the submissions made, the Criminal Petition is disposed of dispensing with the presence of the Petitioner/A.2 before the Trial Court, except on the specific dates as
directed by the Trial Court with regard to the subject matter. Liberty is granted to the Petitioner to raise the contentions at his defence before the Trial Court. Pending applications, if any, shall stand closed.
