1. The present civil miscellaneous petition has been filed for restoration of W.P.(C) No.5328 of 2022 which stood dismissed for non-compliance of the peremptory order dated 15th February,
2023.
2. Counsel for the petitioner submits that the petitioner had earlier filed C.M.P. No.976 of 2023, seeking restoration of the aforesaid writ petition which was defective. On 7th March, 2025, the said CMP was taken up, but no one appeared on behalf of the petitioner. However, learned counsel for the petitioner was
directed to remove the defects by 19th March, 2025. Since counsel for the petitioner could not appear on the said date i.e. on 7th March, 2025, he could not know about passing of the peremptory
order in the said CMP. Under the said circumstance, the present

CMP has been filed seeking restoration of W.P.(C) No.5328 of
2022.
3. Having heard learned counsel for the parties and for the reasons stated in the present civil miscellaneous petition, W.P.(C) No.5328 of 2022 is restored to its original file and stage subject to condition that the petitioner shall pay a cost of Rs.1,000/- in favour of Advocates Clerk Welfare Fund, High Court of Jharkhand, Ranchi and shall remove defect(s), as pointed out by the office, by 3rd November, 2025.
4. This CMP is, accordingly, disposed of.
