Earlier prayer for bail of the petitioner was rejected vide order dated 16.01.2023 in B.A. No.9358 of 2022 on merits with an observation to conclude the trial within nine months. Petitioner above-named who is in custody since 27.11.2020 has renewed his prayer for grant of regular bail in connection with Saiko P.S. Case No.35 of 2020 (corresponding to G.R. No.115 of 2021) registered under Sections 302, 201 and 34 of the Indian Penal Code. Heard the parties. It is submitted by learned counsel for the petitioner that since the date of earlier order, more than two and half years have elapsed, but the trial is far from its conclusion. It is also submitted that there is no direct eye-witness to the incidence and he has been arrayed in the case on mere suspicion. A report was called for regarding stage of the trial from which, it appears that charge was framed on 08.12.2021, but till date, out of seven witnesses, only four witnesses have been examined. Learned APP for the State has opposed the prayer. Considering the submissions and the period of custody and the fact as discussed above, the bail application is allowed. Accordingly, the petitioner named above shall be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Court below subject to the condition that one of the bailor(s) must be Income Tax Payee.
