Heard Sri Neeraj Singh, the learned counsel for the applicant and Sri Mayank Sinha, the learned AGA. 2. Supplementary affidavit filed by the learned counsel for the application is taken on record. 3. By means of the instant application the applicant is seeking cancellation of order dated 22.12.2023 passed by this Court in Criminal Misc. Bail Application No. 15282 of 2023 enlarging the opposite party on bail in Case Crime No. 266 of 2023, under Sections 387, 427, 506 I.P.C., Police Station Antu, District Pratapgarh. 4. Cancellation of the bail order has been sought on the ground that subsequent to release on bail, the applicant assaulted the informant causing gun shot injury to him. 5. Regarding the aforesaid subsequent incident, an FIR has been lodged by the applicant and the opposite party no. 2 has also been taken into custody in connection with that FIR. 6. When the opposite party no. 2 is already in custody in connection with the subsequent FIR lodged by the applicant, there is no apprehension of misuse of the liberty of bail granted to the opposite party no. 2 by means of the order dated 22.12.2023, therefore, there is no occasion for this Versus Counsel for Applicant(s) : Neeraj Singh Counsel for Opposite Party(s) : G.A.
