GP FOR SERVICES II The Court made the following: THE HONOURABLE SRI JUSTICE NYAPATHY VIJAY WRIT PETITION NO: 25614 of 2025 ORDER: This Writ Petition was filed declaring the action of Respondents in not considering the Petitioner’s request for transfer on medical grounds despite submission of detailed representation as illegal and arbitrary. 2. With the consent of the learned counsel, the writ petition is disposed of at the stage of admission itself. 3. Petitioner is working as Secondary Grade Teacher in the school and was initially transferred in March, 2024. However, she was not relieved due to intervening circumstances. Then, the Petitioner filed W.P.No.14196 of 2025 and batch seeking for a direction to relieve them pursuant to the orders of transfer. The said batch of writ petitions was dismissed by this Court on 14.07.2025. The Writ Appeal filed thereon being W.A.No.746 of 2024 was closed as new Transfer Rules were formulated in the year 2025 and the Petitioners opted to exercise their options in the general transfers conducted in May, 2025. 4. The grievance of the Petitioner is that though she had exercised her option in the general transfers conducted in June, 2025 hoping that her case would be considered taking note of the medical and familial issues. However, the Petitioner could not be posted at place of her preference opted. 5. Learned Senior Counsel Sri C.Raghu, appearing through virtual mode on behalf of Petitioner submits that considering the nature of medical and familial issues faced by the Petitioner sought for consideration of her case under the Andhra Pradesh State Teachers (Regulation of Transfers) Rules, 2025 framed under G.O.Ms.No.22 dated 20.05.2025. Learned Senior Counsel for the Petitioner further submits that the Petitioner is unaware of the Rules, to seek her grievance within the time specified before the Grievance Committee. 6. Sri E. Sambasiva Pratap, learned Additional Advocate General, would submit that the cases of the Petitioner was considered as per the option exercised and has been posted at the place of her preference and in the absence of any vindictive approach by the Respondents, the writ petition cannot be maintained. It was further contended that the cases of the Petitioner was considered in the year 2024 and her request for transfer was rejected. The further submission is that there has to be a closure to the plea of transfer and the Petitioner cannot keep on agitating till she is posted at a place of her choice. 7. This Court had perused the orders of rejection passed and it is more on factual scenario at that point of time i.e. with regard to the administration issues, but there is no reference to the grounds on which the Petitioner is seeking transfer i.e. medical, family and other grounds. 8. Having heard the respective counsel, without going into the genuineness of the claims of the Petitioner, the writ petition is disposed of with the following directions: (a) The Petitioner is directed to submit her application to the State Level Grievance Committee as provided under Rule 18 of the A.P. State Teachers (Regulation of Transfers) Rules, 2025 within a period of four weeks from today. (b) On receipt of the same, the State Level Grievance Committee shall examine the grievances of the Petitioner on merits and take appropriate decision, if the claim of the Petitioner is found to be genuine. (c) No orders as to costs.
