This anticipatory bail application under Sections 482 and 484 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, has been preferred by the petitioner apprehending his arrest for offences registered under Sections 147, 149, 341, 324, 326, 307, 353, 379, 427 of Indian Penal Code and section 33 of Indian Forest Act pending in the court of learned J.M. 1st Class, Koderma in connection with Domchanch PS Case No. 122 of 2023. 3. Learned A.P.P. representing the State opposes the prayer for anticipatory bail. 4. A tractor was standing loaded with green and raw 80 pieces of logs of different woods, that too, inside the forest. Admittedly the tractor belongs to this petitioner. The petitioner submits that he has already sold the tractor and he has produced the agreement. 5. A vehicle cannot be transferred by virtue of an agreement. The person in whose name records are maintained in the office of the District Transport Office, should be treated to be the owner of the vehicle. Admittedly the vehicle is registered in the name of the petitioner. Thus, considering the allegation that the vehicle of the petitioner was used in transporting the illegal logs of wood, that too, from forest area, this is not a fit case for grant of anticipatory bail. 2025:JHHC:16617 2 6. Accordingly, this Anticipatory Bail Application stands dismissed. 7.
