THROUGH THE STATION HOUSE OFFICER, SATYANARAYANAPURAM, VIJAYAWADA. ...RESPONDENT(S): Counsel for the Petitioner: SAMBOJU BALA GOPAL Counsel for the Respondent(S): PUBLIC PROSECUTOR 2 Dr.YLR, J Crl.R.C.No.1029 of 2025 Dated.18.09.2025 The Court made the following: ORDER: The Criminal Revision Case has been preferred under Sections 397 and 401 of Code of Criminal Procedure, 1973 (for brevity ‘the Cr.P.C’) challenging the order dated 26.07.2025 passed in Crl.M.P.No.395 of 2025 in C.C.No.17 of 2012 on the file of the learned VIII Additional District Judge, Vijayawada, wherein the petitioner, who was arraigned as Accused No.5, sought issuance of No Objection Certificate and consequential direction to the Passport Authorities to issue a passport to her, which came to be rejected by the learned Special Judge for Trial of Cases under the Andhra Pradesh Protection of Depositors of Financial Establishments Act and Rules, 1999-cum- Metropolitan Sessions Judge, Vijayawada. 2. I have heard the arguments of the learned counsel for the revisionist and the learned Assistant Public Prosecutor. 3. The reason assigned for dismissal of the petition is that a stay was granted by this Court in Crl.R.C.No.792 of 2024 on 19.09.2024 with regard to the dismissal of the discharge petition. In similar circumstances, a learned Single Judge of this Court in Rama Krishna Raju Samanthapudi v. State of Andhra Pradesh1 accorded permission 1I.A.No.1 of 2023 in Crl.P.No.2038 of 2021 3 Dr.YLR, J Crl.R.C.No.1029 of 2025 Dated.18.09.2025 to the petitioners therein to travel to the USA, subject to filing an affidavit of undertaking that, as and when required by the learned Trial Court in connection with the criminal proceedings, they would appear without fail. 4. This Court in Sudheer Reddy Mule v. State of Andhra Pradesh2, granted permission for issuance of No Objection Certificate for renewal of the passport. 5. The learned counsel for the petitioner submits that the petitioner intends to take a journey to Denmark for attending the works of his daughter-in-law’s delivery. 6. Considering the facts and circumstances of the case, the Criminal Revision Case is disposed of by setting aside the order passed in Crl.M.P.No.395 of 2025 in C.C.No.17 of 2012 on the file of the learned VIII Additional District Judge, Vijayawada. The petitioner is permitted to travel to Denmark, subject to filing an affidavit of undertaking with details of her itinerary with necessary proofs like air tickets, endorsements on visa and passport that, as and when required by this Court or any other Court in connection with the criminal proceedings initiated against her in C.C.No.17 of 2012, she shall appear before the learned Trial Court without fail, and co-operate with conclusion of Trial. 2Crl.P.No.8013 of 2025, vide order dated 18.08.2025 4 Dr.YLR, J Crl.R.C.No.1029 of 2025 Dated.18.09.2025 7.
