Heard, learned Advocates appearing for respective parties. 2. By this application, claimant seeks to condone the delay of 2043 days caused in filing application. Applicant is pursuing his remedy for just compensation towards acquired land. 3. Perusal of the application shows that the delay has been occurred on account of financial difficulties. It does not appear that applicant has derived any advantage by making delay or delay is intentional in any manner. 2025:BHC-AUG:5234 2 57-ca-249-2025 4. In that view of the matter, delay can be condoned by putting certain conditions. Hence following order: ORDER a. Civil Application is allowed. b. Delay of 2043 days caused in filing appeal is hereby condoned, subject to condition that applicant files an undertaking to learned Registrar (Judicial) of this Court that they shall not claim interest and statutory benefits on the compensation amount, in case appeal is favourably considered and enhancement is granted. c. Such an undertaking shall be made part of the compilation of the appeal. d. If this Civil application stands disposed of, undertaking to be filed within a period of six weeks from today. ( S. G.
