ORDER:
This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for:
“…pleased to issue a Writ, or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents No. 3 to 6 in interfering with physical and peaceful possession and enjoyment of the land to an extent of Ac. 0.74 cents out of the Suit Schedule Property of Ac. 0.92 cents in OS No. 364 of 2025 out of total extent of Ac. 1.84 cents in Sy. No. 115/1 of Upparapalle Village, Proddatur Mandal, YSR Kadapa District while pending the OS No. 364 of 2025 on the file of the Principal Junior Civil Judge, Proddatur as being illegal, arbitrary and is in violation of Article 21 of the Constitution of India and runs in the defiance of principal of law laid down in D.B.C. 2. Heard Sri Sambaturu Rama Chandra Reddy, learned counsel for the petitioner, and Sri V. Farooq, learned Assistant Government Pleader for Home, appearing on behalf of the official respondents.

When the matter was taken up for hearing, the learned Assistant Government Pleader, on instructions, submitted that on the complaint lodged by the 5th respondent, the petitioner was called to the police station for enquiry. It is submitted that no crime has been registered against the petitioner and that the police are not interfering in the civil dispute between the parties. It is further stated that the petitioner was only called for enquiry in connection with the complaint and there is no intention on the part of the police to interfere with the civil disputes.

Learned counsel for the petitioner would submit that recording the same, the petition may be disposed of.
5. Having regard to the submissions made and in view of the fact that the dispute is purely civil in nature and O.S. No.364 of 2025 is pending before the
competent Civil Court, this Court is of the considered opinion that no further orders are required in this Writ Petition
Accordingly, the Writ Petition is disposed of. However, the police are
directed not interfere with the civil dispute between the petitioner and the private respondents, which is already pending adjudication before the competent Civil Court and the police shall not summon or call the petitioner to the police station except in the event of registration of any cognizable offence against him by following due process of law. There shall be no order as to costs.
As a sequel thereto, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
