The respondent-Kapoor Singh had filed a suit for declaration to the effect that orders dated 30.04.1989 and 09.05.1989 are illegal, null and void and the said suit was dismissed but the appeal filed by the said Kapoor Singh was allowed. Although all the zimni orders in the present case are not available on the file but a perusal of paragraph 1 of CM-5079-C-1999 filed for early hearing of the case would show that it had been stated in para 1 that when RSA was admitted on 19.01.1998, the operation of the impugned judgment was stayed. 2.
