1. Heard Mr. Jitendra Shrivastava, learned Government Advocate, appearing for the applicant/State. Also heard Mr. Shikhar Bakhtiyar,
learned counsel for the respondent.
2. The present revision has been filed by the applicants with the following prayer:
“ It is therefore prayed that this Hon’ble Court may kindly be pleased to allow the revision of the applicant and further may kindly be pleased to set aside the order dated 24.09.2016 passed by the RAJSHEKHAR SONI Digitally signed by RAJSHEKHAR SONI
2 Court of Sessions Judge, Balod in Criminal Appeal No. 82/2016 rejecting the application under Section 5 of the Limitation Act and further be pleased to direct to condone the delay in filing the appeal before the Court below, in the interest of justice. ”
3. The present criminal revision is beyond time as has been reported by the Registry.
4. From perusal of application for condonation of delay, it is apparent that the applicant has not given day to day explanation of inordinate delay of 161 days in filing the revision, as such, the revision is barred by delay and laches and is not liable to be entertained.
5. Considering the grounds raised in I.A. No. 01/2017, I do not find any good ground to condone the delay of 161 days in preferring the revision.
6. Accordingly, I.A. No. 01/2017 is rejected and consequently thereto, the revision is also dismissed.
