02/ 10.10.2025 Heard learned counsel for the petitioners and learned A.P.P. for the State.

The petitioners are apprehending their arrest in connection with Nirsa P.S. Case No. 373 of 2025, registered for the offences under Sections 126(2), 115(2), 329(4), 109, 118(1), 74, 352, 351(2), 351(3), 3(5) of the Bharatiya Nyaya Sanhita, 2023, pending in the court of learned Judicial Magistrate 1st Class, Dhanbad.

Learned counsel appearing for the petitioners submits that there are case and counter-case between the parties and the present case is the counter blast of the case being Nirsa P.S. Case No. 374 of 2025 in which the petitioner no.3 and others have been brutally assaulted and sustained grievous injury and admitted in Ashrafi Hospital. He also submits that the petitioners are the relatives of the informant and there

are certain family disputes going on among them since last few months. He submits that false allegations are made of creating of the fake ID and maligning the image of the informant’s niece.

Learned counsel appearing for the State opposes the prayer and submits that the allegations are there.

Considering that there are case and counter-case between the parties and in the second case which was lodged by the petitioner’s side, the petitioner no.3 and others have received the injury, I am inclined to provide anticipatory bail to the petitioners.

Accordingly, the petitioners, above named, are hereby
directed to surrender before the learned Court within three weeks from today, and in the event of their surrender/arrest, the petitioners, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each, with two sureties of the like amount each, to the satisfaction of learned Judicial Magistrate 1st Class, Dhanbad in connection with Nirsa P.S. Case No. 373 of 2025, subject to the conditions as laid down under Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023.
