The present application under Section 528 of Bharatiya Nagarik Suraksha Sanhita, has been filed with a prayer to issue a direction to the opposite party no. 2 to comply the order dated 04.08.2007 and 02.02.2018 passed by Sub Divisional Magistrate, Padrauna at Kushinagar (opposite party no. 3) in Case No. 49 of 2007 under Section 133 of Cr.P.C. within stipulated period. After some arguments, learned counsel for the applicant does not want to press this application and wants liberty to file an appropriate application/ proceedings before the court of competent jurisdiction.
