Case of the prosecution, in brief, is that on 19.08.2024, on receipt of credible information, the Sub-Inspector of Police along with her staff and mediators rushed to Vasantha Vihar Layout, Dharmapuri, and caught the accused in possession of 22.785 Kgs of Ganja. The contraband along with other material was seized under the cover of mediators report. 3. Heard. Perused the material on record, `T_- tr-`- krI ._`--`.-_- 4. Learned counsel for the Petitioners contended that the Petitioners were arrested on 19.08.2024 and since then they have been in judicial custody and that statutory per-lod of 180 days is completed and POliCe have not filed charge sheet and requests to enlarge the petitioners on bail. 5. On the other hand, learned Assistant Public Prosecutor also confirms non-filing of charge sheet by the police even after statutory period is completed, but opposed to grant bail. 6. As seen from the record, the Petitioners Were remanded tOjud'lCiaI custody on 19.08.2024 and charge Sheet has not been filed. Most of the witnesses are shown to be official witnesses and the release of the accused would not cause hampering of investigation. The petitioners had permanent abode and there is no possibility of their fleeing away from justice. lt is submitted by the learned Assistant Public Prosecutor that the petitioners herein have no previous crime record. 7. ln view Of the aforesaid facts and Circumstances Of the Case, this court is inclined to grant bail to the petit-loners herein with the following conditions: i. The petitioners herein/Al to A3 shall be released On bail On their executing a personal bond for Rs.25,000/-(Rupees twenty five thousand only) each with two (o2) sureties for a like Sum each tO the Satisfaction \=---== ------ + of the learned special Judge for Trial of Cases under NDPS Act-Gum-I Additional Sessions Judge, Vizianagaram. ii. on release, the petitioners shall appear before the Station House Officer concerned, Once in a fortnight i.e., On lst and 15th of every month between 10.00 AM and 01.00 PM.I for a Period Of three (3) months. iii. The petitioners are directed not tO hamper the investigation and tamper with the prosecution witnesses. 8. Accordingly, the Criminal petition is allowed.
