3. Heard on the Delay Condonation Application.
4. The delay of 22 days in filing the Special Leave to Appeal is sufficiently explained. There is no objection from the other side. Accordingly, the delay is hereby condoned and the Delay Condonation Application is allowed.
5. The present Special Leave to Appeal has been filed on behalf of the State seeking leave to appeal against the impugned judgment and order dated 10.09.2025, passed by the learned Special Sessions Judge (NDPS Act)/Sessions Judge, District Uttarkashi in Special Sessions Trial No. 22 of 2022, State vs. Vinod Nautiyal and Another, arising under Section 8/21 of the Narcotic Drugs and Psychotropic Substances Act, 1985.
6. Upon consideration of the submissions advanced by learned counsel for the State/Appellant, this Court is of the view that, at this stage, sufficient grounds
exist to grant leave. Accordingly, the Special Leave to Appeal is granted.
7. The Registry is directed to prepare the paper book and furnish copies thereof to learned counsel for the parties in accordance with the Rules.
8. Objections, if any, be filed by the Respondents.
9. List this case on 08.06.2026 for final hearing.
