1. The instant pre-arrest bail application has been filed under Section 482 BNSS filed on behalf of the petitioners, who are having apprehension of arrest in FIR No.87/2024 registered at Police Station Pratapgarh, District Alwar for the offences under Sections 323, 341, 504, 506 & 143 of IPC. Investigation is being conducted for offences punishable under Sections 323, 341, 504, 506, 307, 325 & 34 of IPC.
2.
Learned counsel for the petitioners submits that petitioners have falsely been implicated in this case. It is submitted that alleged incident took place on 10.04.2024 and on the same day, all injured persons were examined by the medical expert. It was opined by medical expert that injury sustained to injured persons
[2025:RJ-JP:10000] (2 of 3) [CRLMB-14433/2024] are simple in nature. It is submitted that on the person of injured ‘K’, one simple injury was found and on the person of injured ‘S’, three simple injuries were found which were caused by blunt weapon. It is contended that later on, fresh MLC was prepared on 01.08.2024 and it was opined that sole injury sustained to injured ‘K’ is grievous in nature and said injury is life threatneing which has been caused by blunt weapon. It is contended that statement of both injured persons were recorded on 11.04.2024 i.e., a day after the alleged incident took place and it reveals that there is omnibus allegation against the petitioners. It is contended that cross cases have been registered between the parties. Custodial interrogation of the petitioners is not required in this matter. 3. Learned Public Prosecutor opposes the submissions made by counsel for the petitioners and submits that after considering the entire material available on record and MLC of injured ‘K’, it was opined by medical expert that injury sustained to injured ‘K’ is life threatening. 4. I have considered the contentions. 5. Having regard to the totality of the facts and circumstances of the case; considering the arguments advanced by the counsel for the petitioners and so also considering the material available on record in the form of case diary including opinions expressed by medical expert, but without commenting anything on the merits/demerits of the case, I deem it proper to allow the pre- arrest bail application. 6. The anticipatory bail application is allowed. The S.H.O/I.O/Arresting Officer, Police Station Pratapgarh, District
